Dad off work sick, unlikely to ever be fit enough to return

My Dad has some bad problems with his back and neck. They have been ongoing for at least 20 years but now he can hardly walk.

He has been told, following a MRI scan,that he has 2 slipped disks in his neck,and 3 in his lower back.

He is having an injection into his neck tomorrow for which the doctor has told him he will need at least 6 weeks rest after the injection, and is going to have surgery on his lower back sometime in the near future.

He is a plumbing and heating engineer, and has been told the likelyhood of returning to work is almost nil.

So,he's coming upto being off work 6 months and his SSP will soon stop.

The employer has refused to make him redundant and has always said he will keep him on the payroll even if he has no ssp to receive.

If my Dad cannot return to work, and gives this information to his employer in the form of a letter from his specialist, would the employer then have to look and making my dad medically retired and therefore giving him a redundancy package?

Or, can the employer sack my dad on the basis of his sickness absence?

Just looking for an answer as it will obviously make a difference with regards to his future income.

    This information is correct.

    Your dad can't fulfill his contractual obligations as he is poorly. The job is still there hence no redundancy.

    Usually employers dismiss employees who have too long a period of sickness.

    Sorry to be negative, but Vader and JDTurk are correct, and the next step should be a call to CAB or other advice agencies for a benefit check, to see what his entitlements are, and also what if any retraining may be possible based on what capability he has for some form of work.

    The ESA brigade will likely refer him to ATOS Medical for a capability assessment in the near future, if he has to claim ESA.
