do these companies ever take you to court or do they just keep constantly writing to you, threatening court action?

    Lowell do sometimes take people they do take you to court, often not. Don't know about the other but I imagine they are all pretty similar.

    Depends on the circumstances surrounding the debt? what was the debt for? how much etc? how much are you paying to pay it off?

    The more you owe the more likely they are to take you to court. Also if they think you can afford to pay more than you are they again are more likely to take court action.

  • it is for about £5000, the things is they have been writing to me off an on for over a year, there is no trace of these debts on my credit expert record, i have sent for a CCA from one of them, but they just keep sending the same letters

  • the debt was for a student loan, not too sure when i defaulted probably around the 2005 time. i have asked for official documentation but they have not sent it.

    Old style student loan?
    If you haven't paid anything since 2005, or acknowledged it in writing or asked for it to be deferred it could be statute barred sometime next year - if they don't get a CCJ before then.

    If new style loan then it cannot be SB.

    When did you ask for the agreement? did you send a £1 postal order? This could count as acknowledging the debt (its not totally clear whether it does or not).
