    Sorry if I sound like a madman but that's because the system do what ever they like. If the six year thing is correct then I should have nothing showing on me but the banks just reregister the defaults when ever they want.

    They shouldn't do.

    If they have done that, or waited years and years before recording a default, then you would have cause to make a complaint to the Information Commissioner under the Data protection Act.

    Banks and debt collectors have a duty under the data protection act to make sure that the data they record on your credit reference files both fairly and accurately represents your account history.

    As such, they can only:

    - Register a default once for each account. They cannot add another, or move the date of it forward.
    - If they are to register a default, then to be fair it should normally be placed/dated within 6 months of the time that you no longer make contractual payments.

    If they break those principles, then you can complain to the ICO who have the power under the DPA to require them to correct the data on your files.

    I agree - my Dad was made bankrupt years ago, and after about 2 years he had the best part of 50,000 in credit cards (not that he uses them)

    Not on the main Online Insolvency Register.

    However, there "supposedly" is a longer term version held by the Insolvency Service that mortgage lenders can check?

    Plus of course, a bankruptcy will be recorded and searchable online forever via the London Gazette website.

    Yep found him on there BR date was November 1991 so almost 20 years. He's had no credit since so I would think he would be okay for a mortgage etc (not that we are going to get on or anything).

    I think there are records on there going back to the 1800's or something like that. :eek:
