Just an update , I sent them a prove it letter as stated and made an official complaint also. Well yesterday I recieved a letter stating that I defaulted on a Barclays loan in 1998 ,well that can not be as I have never had a loan from Barclays or any dealings with them. Should I tell them to prove it it writing with a signature or take legal action as this is def false0 -

Well yesterday I recieved a letter stating that I defaulted on a Barclays loan in 1998 ,well that can not be as I have never had a loan from Barclays or any dealings with them. Should I tell them to prove it it writing with a signature or take legal action as this is def false
(2) File a complaint with the appropriate financial regulating authority.
(3) Make a Data Protection Act request to see what information they hold (or think they hold!) on you.
(4) Make a complaint to ICO (information Commissioners Office. They deal with data protection issues), on the grounds that they have an inaccurate database that they are refusing to correct. Well guys looks like they could not care less , as when I came home from work on Fri a letter was put HAND DELIVERED - with a note basily saying payup or else. They have not shown me any eveidence of a debt even thou I sent a prove it letter. Surely what they are doing is wrong.0

If they're gonna play this far outside the rules/the law then I think you ought to think about getting representation. Report them to the OFt as they have alreadty been "given guidance" and it needs as many folks as possible to complain.
Please do not get worried or feel embaressed by this - get anger and outraged.If you've have not made a mistake, you've made nothing0 -
Use the template I have put on this thread. DarkConvict has kindly given you all the breaches of the OFT Code to complain about.
Ask for compensation for the distress and embarrassment they have caused if necessary complain to FOS - NOT the OFT - as FOS can investigate individual complaints and award redress but the OFT cannot. Make sure FOS are aware of all the aspects of the code that have been breached and if necessary insist on an Ombudsman's decision rather than an adjudicator's.
It will also cost them £500 if you go to FOS.0
