Can you counter claim on this?
Almost certainly. The catch is, she won't have any money to pay costs, compensation etc. Best option is to stop it getting to court. It is possible to ask for a claim to be struck out.

I would be amazed if it even got as far as being lodged as a fully fledged case then - send the solicitor copies of the test and the CSA paperwork accepting the results and let them fill their boots.

Do, please, respond to the solicitor - check the address on the Law Society website if you're not 100% sure. You can't count on the solicitor reading the letter or taking notice of it but if a 15 minute letter stops them making an application you'll at least not have to spend a few hours sat around at the court.

When you apply for a DoP, you HAVE to attach the DNA test results with a positive result - she doesn't have it so it won't get as far as the mailroom. It's as simple as that.

I would tend to agree with others OP and let it run it's course as you are comfortable in the knowledge - and indeed have proof - that you are not the father of the baby. By the sounds of things you are the better option financially wise out the three and she is desperate to pin it on you. Silly foolish immature woman.

Not helpful when she is causing the stress just now but just grit your teeth and know you have the upper hand.

DUTR - DNA tests have 2 results which are either 99.99% positive or 100% negative. If you are not the father you are not the father and the DNA sample doesn't match up at all hence why it can be a confident 100% negative.

Keep us posted OP and just ignore comments about not getting support...some people just have a huge chip on their shoulder;)

I was just having a wee think there...OP, could you not consult a lawyer (free for 30 mins) to see about getting some kind of restraining order as she is continually harrassing you?

Fathers should pay for their kids, full stop but you are clearly NOT the Dad and should be able to live your life in peace without all this bloody nonsense:mad:

Also as well, she has already managed to screw money from the CSA as the money you paid will have been passed on to her but when you got it refunded they wouldn't have asked her for the money back although they sodding well should have....

Honestly, I'm sometimes embarrassed to be a woman:mad:

Well that's the best answer of all!

It won't get to court I can assure you...I have been through the whole DoP process hence my knowledge on it.

You can't just randomly pick a man and the courts will make him the Daddy!!!

Initially the DoP form would get sent to you in any case. Only if the father refuses to complete it (and the Mother has proof via a DNA test) then would it get sent to court and the court would allow it. But they can only allow it as they have proof in black and white.

The most she could ask would be for you to do the DNA again. Whether you choose to do it (at totally her expense of course) and get her off your back once and for all is up to you.

And as for her crap about the DNA test being dodgy!! Jesus...that's why you have to take photo proof and the GP has to sign that you are the person in the photo...and if it was your OWN GP that done it!!! *shakes head*

Stay strong OP...she sounds like an extremely bitter and twisted person who is stuck in time of 3 years ago. I suppose that's what happens when you have unprotected sex with 3 men at the time of conception though...classy;)

I would really like to see how this pans out so would apprec if you keep us posted....you can always come here just for a moan as well;):rotfl:
