AEQUS Finance

I need urgent help!

2006 I enquired about a home learning college course in travel & tourism. They advised a guy would come to my house with the information. When he came he was a horrible salesman. He wouldn't leave until I signed up to something (at the time I was not well suffering from depression so was an easy push over as I was at home allot I wanted to look into the idea of home learning but didn't want to commit) I phoned the college to say I didn't want to carry out the course anymore. They said don't worry as I had not received course material. I have spoken to them today and they said they have no details of my calls to cancel back in 2006. I made a payment of £50 in April 2006 and they said on their system they made me aware I needed to make more payments even though I said I don't want to do the course. They have said to me they would never of said the course was cancelled without a letter but I was not advised to write in.

I realised I couldn't pay my bills with not working So I put all my financial arrangements with a company called Church wood, I am now in the process of getting rid of churchwood and paying companies direct (which is great). However when looking at who I have been paying one is for Buchanan Clark & Wells who advised are on behalf of Aequs Finance who do finances for home study courses. I have always thought Buchanan & Wells were being paid on behalf of NEXT directory until today when I found out. anyway How can I be still paying for a course that I have never received course material, i have and am paying for something I don't have. The Home Learning college said today that you sign up to a contract so nothing I can do and the course can take a life time to complete there is no expiry date. They have no record of my calls requesting to cancel.

Sorry to woffle but really don't no what to do, the world is in a financial mess and I am on the way to sorting my personal debt out with loans credit cards etc and a college is forcing me to pay for something that they can so easily write off. But I cannot do anything as I signed an agreement

    I don't have anything but when I called the home learning today they said I have an agreement.

    Looking at it if you did not receive the goods you cannot be charged.
    If goods are not delivered on time


    The seller must deliver your goods by the agreed date. If no date was agreed, the seller must deliver within 30 days of the order being placed.

    The seller should let you know if the goods can't be delivered on time. If you don't want to give the seller more time, the trader should reimburse within 30 days.

    If the date for delivery has passed and you haven't received anything, treat it as though you had never placed the order. If you have already paid, demand a full refund.

    To cancel your order, you must tell the seller in writing - by letter, fax or e-mail. If sending a letter, send the letter by registered post, so you can prove that you sent it and track its progress.

    I went to see the citizens advise earlier today regarding this worry of mine....I cannot believe I sat with them to check out AEQUS finance and have gone into liquidation. Therefore I have been paying Churchwood, who have been paying Buchanan & wells ltd who have been paying nobody!!!!!

    The advice from Citizens advise is to do nothing, they said as I am getting rid of Churchwood anyway and have dealt with the other companies and made my own agreements with them, don't bother contacting Buchanan and Wells if they contact me then I should take it further and go back and see citizens advice who will then help me further. She said let them take me to court.....but she said it certainly won't get to that!!!

    All because AEQUS no longer exist it does not mean no one gets paid, debts are assets and these can be sold.

    But i agree if its in dispute they probably will be unable to track down the contract and information as such court action maybe inadvisable.
