Marks & Spencers not sending goods

Quick bit of advice please, I bought a bunch of stuff from M&S in the sale. One lot of 4 was apparently sent in 2 batches (3 & 1). The lone item, a pair of slippers for the wife, went missing and I reported this to M&S a week or so ago.

At first they said they would try to send me a replacement pair but they're now saying they're out of stock and they want to refund my payment.

Quick question, am I within my legal rights to ask for a suitable alternative? I thought that by paying for the goods (after all the acknowledgements and delivery advice emails) then they were now obliged to supply the goods and, if they couldn't, I'd be able to claim a 'loss of bargain' type compensation to buy an alternate product.

Anybody know where I stand?
