Am I not getting something???

Ok a bit of a strange one...but something I don't understand.

Under the new rules a PWC on IS is entitled to keep all maintenace payment???

If this is the case surely the Government are losing money...as my understanding was ...under old rule PWC on IS kept approx £20 of maintenance payment ...the rest of the payment going back to the Secretary of State?

Also if a NRP has arrears of say £5000 ....and for arguments sake say £3000 is owing to the PWC and the other £2000 owing to Secretary of State [as PWC was on IS for a period of time ]....would the £2000 still go back to Secreatry of State now that the new rule has now come in to force?.......this being based on the situation occuring prior to New Rule?

I'm sorry if I sound a bit thick.

No because the 2000 arrears accrued before the april 12th change to the benefit disregard I can expand further as I have SOS debts (alleged) and they are still current I.e the pwc gets none of them

Yes thats right - so if you are on IS and you have a CSA liability from the NRP of £200 a month, you get full IS, full HB, CB, CTC, CB and you get to keep the £200.

Yup thats right - whereas the govt before used the CM to offset the cost of the state keeping your child and pwc now they let the pwc keep it all.

As CSA_Help has said any arrears accrued before the disregard will go back to SoS but otherwise anything that is still owing to the pwc will go to them.

And yes it is a totally ludicrous piece of legislation.

Don't know if they will tell the NRP as it is PWC info and not relevant to them.
