Robinson Way not helping.

I have my fingers crossed that someone will be able to help. It is a long story but please stay with me.
My Fianc! has an issue with Robinson Way Debt collectors.
Nearly 9 years ago my Fianc! and his ex partner took out a home owner loan with HFC bank, Unbeknown to him, his ex partner was not paying the mortgage or loan and he found this out when they split up and was selling the house. By this time HFC was in the middle of selling the loan debt on to Robinson Way. My Fianc! and his solicitor agreed to pay all outstanding money once the sale of the house had gone through and called Robinson Way to sort out making the payment. Robinson way told the solicitor that the amount due was c. 9k to which my fianc! said that the figure was too low and it was more like 18k. They said that it was 9k to settle the debt. Robinson way also gave the account number to write on the payment. The money went off and all was well for 2 years when they started calling my fianc! up demanding the payment off the account. What had happened was that Robinson Way gave over his ex’s personal account number and the money had been sent to pay that off. When Andrew tried to sort it out they just said that it was a gift to the ex.
For a year or so after Andrew made payments to a door step collector as he was living with his parents and his mum was dying from cancer, so he did not want any fuss. He then decided that he was not willing to do this anymore as he didn’t owe 18k. He wanted them to sort out the payments which they would not do.
A few years pass where he does not have any contact with him and then they start pestering him again. Each time he calls them, they say they will sort it out and call him back but they never do.
About a year ago Andrew received a letter to say that they would wipe the debt for 9k, so he calls them up to tell them to transfer the money that was already paid and then the debt would be cleared up. Someone on the phone said they would do this and it would be all sorted. Then someone else calls asking for the money again. Andrew once again explains that they were sorting it out and he was just told that the letter was sent in “human error” and they wanted all their money otherwise it would go to court. Andrew asked them to take it to court but then 2 days later he gets a call from their solicitors to say they want to work something out. A year later we are still getting these calls and no one will help us. We have sent them a subject access request and within the 40 days they only sent us screen dumps of their computer screens. They do not appear to have anything on record. We have all the letters that have been passed between us. I then did the same to HFC but that was about 80 days ago and we still have not heard anything from them. They told us they could take more than 40 days as the debt was so old.
I am pulling my hair out and have no idea what to do now. Can someone please help me?

Was this a secured loan or unsecured? If it was securedm, it may have become unsecured when the house was sold.If you've have not made a mistake, you've made nothing0
-
It was a secured loan but that surely makes no difference to this matter?0
-
Because the law on secured and unsecured debts are different.
It sounds like the solicitor failed to ensure that RW accepted the (k payments as a full and final settlement of the outstanding debt.
The whole thing is very convoluted and without clear information as to why RW appear to have paid the money over to his ex, it is really not possible to help much.If you've have not made a mistake, you've made nothing0 -

Im totally confused, the DCA asked for £9,000 to settle the debt. You sent them the payment but they are still chasing the debt?
As to phonecalls you can send this letter (list to send, onces mentioning DPA are most important) -http://forums.moneysavingexpert.com/showthread.html?t=1837507

But in reality it sounds like a total mess. Get the FSA/FOS involved in this and get it resolved once and for all by the government regulatorAlthough no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0 -
They paid it to the wrong account as they didn't look it up correctly on their computer screens when the solicitor asked for the information. They were even told it was the wrong amount yet they still said it was correct.0

If Robinson gave the incorrect information or paid the wrong people, that is not your problem it is there's, you made payment to them the debt is over, so long as you have it in writing it settled the debt in full.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

Robinson Way gave over the account number to the solicitors after they asked for the details. The money was sent over to them by the solicitors. As Robinson gave the wrong number in the first place the money got sent into the wrong account by the solicitors. We have a receipt for the money but of course the account number is for the personal loan of the ex.
The solicitor has closed his business since then due to retirement so we can't even go back to them.0 -
I know it is Robinson Ways problem and not ours but they are not helping us in any way, they ignore us. We can't afford to take it to court ourselves.0
