probably a stupid question

my husband pays csa to his ex for his 2 children they take into account our tax credits for the 3 children we have at home,my ex has just had to start paying £5 per week as he now on benefits (when he was working couldnt get a penny voluntarily) he has 3 children in his household so they must get tax credits too so why are they not taken into account?

    I'm not an expert on this but I understand why you are asking. BTW there's no such thing as a stupid question. ;)

    Your NRP tax credits may be taken into account but it might not raise his income above the level of paying £5 because he is on a low income. It could depend on whether the case is on CS1 or CS2 also. I think it's probably because he is on a certain benefit that means nothing else is taken into account. There are so many rules on what counts as income etc, that it gets very confusing.

    Tax credits are taken into account if working, but if a person is on income support of JSA then it is a flat rate of £5 regardless of the tax credits.

    thanks for your help just thought would ask as our tax credits bring us up to around that of someone on benefits (obviously we dont get council tax benefit or housing benefit but the values equate to the same) just dont seem fair really
