Please help Equita baliffs are making my life hell

Can anyone please help/advise me. I have an unpaid parking ticket. after a battle with the local council which got me nowhere i received a baliff removal notice (hand delivered). i phoned them and they told me that i had an order from northampton county court.( I have never received this letter) the baliff got rather rude and told me i had to pay 450. im a single unemployed parent so im on income support. it was aggreed that i pay 20 a week via direct debit. I had to pphone the baliff with my bank details and for the past 2 weeks all i have got is either him telling me he cant take my details because he is driving or to call back at 6pm which i have done so numerous times and he never answers his phone. Yesterday morning i received another hand delivered notice from another baliff and again i have tried to phone him to give my details but his phone is switched off I have left three voicemail messages for him but i still have no reply.I am getting very worried because the letter says that if i dont contact them they will be removing goods within the next 48 hours. Please help as this is making me so ill with worry Thankyou.

    This is potentially a mess but you need a bit more information.

    Northampton are the bulk processor for CCJs, and if you have not had paperwork, you can overturn the CCJ.

    Can you find their phone number and ring them ASAP and find out if they have issued a CCJ.

    There are a few circumstances when bailiffs can attend to remove good re non-payment of court fines, with a locksmith, but the 48hour limit is probably a bluff.

    we do have the e-mail addie for equita, which you can send a message very much along the lines of you first post.

    You also need to read up on the situation re parking fines on the bailif advice line, will try and find the link. if you did not get the letters re court, you can overturn the ruling using an out of time declaration.

    please try not to worry, i know these bailiffs can be horrible, my partner had a similar situation recently where he had complained about the parking ticket but then received a bailiff notice.

    The MOST important thing to know is that if they do for any reason come to your property DO NOT under any circumstances let them in. They cannot force entry to your property unless you let them in first.

    My partner contacted the Traffice Enforcement Centre (that is Northampton County Court) and explained that he had not received any notification from the court.

    You should have received a letter from the court with a Witness Statement so you could put your side of things. If you did not recieve this then you can apply to file a Witness Statement Out of Time and they will tell u which form to use (its on the internet). The court will then decide whether you should have a chance to put your side of things and they do this within 24 hours (tell them its urgent)

    In my partner's case they decided in his favour which meant the Local Authority had no choice (legally) but to call the bailiffs off until his complaint had been looked into. Even if you still have to pay the parking tickets, you will not have to pay the bailiff charges.

    You should note that only the Local Authority who issued the parking ticket can call off the bailiffs and they will NOT do this until you get a decision from the court.

    You need to say something along the following lines.

  • Thank you so much for you advise, it is extremely helpful. I have downloaded the form. and have also sent equita an e mail. I will also send them a letter. I have finally heard from the baliff and he said that if i start to pay them 20 a week the when the courts have made their decision i may well get back any charges (Actually had quite a nice conversation with him he was quite helpful and agreed that most baliffs will use underhand tactics to get the money. I will keep you posted of the outcome THANK YOU AGAIN .
