CCA What next???

Hey Guys,

I sent a cca request and cheque to Buchanan Clark and Wells about an old o2 phone account. The next day they sent the cheque back with a reply that they dont have the cca as they are not the creditor and i can only get that from the creditor.

Since then they are ringing my house none stop as early as the same day the leter arrived~

I was just wondering is the debt enforcable or how do i get the cca?

    They do have to provide the CCA, if they don't have it then they should request it from the creditor not you. You need this link

    I'm not 100% sure but I don't think you can claim a CCA unenforceable on phone contracts.

    Thanks Il do that tomorrow! Can i ask you where it says 'sign digitally' does that mean dont personally sign the letter? Iv read a post about being weary of sending cheques too and i am worried now!

    if its a utillity bill you can not cca them, cca is only for loans, credit cards, but does not cover bank accounts ,over drafts or utillity bills hope this helps

    Thanks Locke iv just read that is it only loans, credit cards and finance agreements? I did have a littlewoods account and they couldnt find cca so that got taken off my credit report I thought it may be the same with phone contracts? x

    Oops, sorry didn't read the phone contract part (or scan read so it didn't sink in) thats right you cannot do it with a service contract, which a phone is.

    Phone contracts are services agreements, not credit agreements. You cannot do a CCA request for 02.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

    If you have disputed the amount then take it up with the complaint department, if that fails then OFCOM http://www.ofcom.org.uk/complain/mobile/
