how long before they have to right off the debt?

my DH had a letter this morning demanding payment for some mobile phone he had in 2000. I thought that after a certain amount of time they had to right off the debt?? It has been over 6 years and apparently they have been looking for us (not very hard if its taken 6 yrs). any anvice would be great, thanks

Basically the limitations act will prevent further court action being taken if the date of last payment or admission by the debtor is over 6 years ago.

I'm not sure, but 6 years sounds about right. I know that a few years ago I wrote to a creditor offering payment and they had no recollection of the account after only a couple of years since last contact with them (needless to say I didn't bother them again!!!). Probably depends on the company and debt amount as to whether they will pursue you for the maximum length of time.Official DFW Nerd #148

the collection agency said the debt is from 11 august 2000 and is £300. not heard anything from them until today. Dh has asked for it all in writing. As he has no knowledge of the debt.Smile and be happy, things can usually get worse!0

Sounds like they are trying to keep a 'debt' alive, and out of the six year statute barred rule, where if they have not pursued a debt for six years, they are barred from further pursuit (better explained by others). I expect the letter was dated one day before six yrs from alleged debt.
They must (OFT) give you a full statement, if you ask - then you can question it.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

there is no date on the letter and the envolpe is prepaid type so so postage stamp on that either. I would say they sent it on the 11th. went on to the national debt line website and printed off a letter will send in the morning recorded. will have to wait it now no I thinkSmile and be happy, things can usually get worse!0
