DEO problems

Been after maintainence for 14 years ( he left and refused to see our children)...finally he couldn't dodge it any more and beginning of last year he volunteered to pay via DEO. I thought odd but case worker said it was good.
Well since then i havnt had the correct payment and many months are missed. Twice i have been told letters have been sent and within 12 weeks a face to face officer will go to the "employer" but it never happens.
The money i receive when i do get it is less than if he were on benefits..which he isnt.
Ok...my question is seen as i cant email my MP again due to the election (he was great speeding up my case in clerical) is there another effective way to get things moving...i am tired of being treated like a moron and being lied to or should i wait till the election has blown over and email my MP again.
Has anyone else had to deal with DEO problems like this and what happened.

The results from seats around the country will be known on Friday for the vast vast majority of seats.
Perhaps you are able to wait a day and half to contact your mp?When dealing with the CSA its important to note that it is commonly accepted as unfit for purpose, and by default this also means the staff are unfit for purpose.0 -
Friday morning - whoever is your MP, get on the phone and get an appointment. Whatever happens nationally, most local seats will be decided fairly decisively, and they work for you, so get the most out of your taxes

Have you asked the CSA for a breakdown of what he should be paying and why it has not been paid correctly? I would ask for it to be passed to enforcement if he is not paying correctly - either he is having it deducted and the employer is holding onto it OR he is not paying it correctly (either because he has told them it doesnt need to be paid or he is in the pay office.....).

Personally, i think my ex does have some kind of hold over the payroll. I had a new breakdown a couple of weeks ago..and so did he i would imagine..it told me that his arrears is now in the £1000's and how much he should pay. The following payment was not only late but laughable! He really is taking the P!
I have asked why he isnt paying the right amount..i have been told ...cant get hold of payroll, he didnt earn enough that month (sorry but if for 18 months you havnt earnt enough, why no re assessment?) and then i am told it is with enforcement..but..nothing is ever done!
Going by the fact that my ex has tried every trick in the book to dodge paying i believe he is playing the system.
Ill email my MP next week and hopefully he can kick the backsides of the CSA again!0 -
You want to ask your MP to tell the CSA to sent the inspectors into his employer to check to make sure that what is being said is the truth.0

DEOs are one of the normal ways a non-resident parent can pay child maintenance through the CSA, but they can also be applied if the non-resident parent fails to agree a payment method or misses payments. Although the decision to apply a DEO is taken by us and not the courts you would be committing an offence under section 32(8) of the Child Support Act 1991 if you do not comply with a DEO. This could lead to a prosecution and a fine.
When we send you a DEO for one of your employees please give it to the person who organises the payment of wages or pensions in your organisation. You must deduct the amount shown on the order. The amount will include the regular child maintenance amount and any arrears that may be due. If one of your employees has more than one DEO applying to them, deductions should be taken in date order.
Once you have sent us the money you have deducted and it has been cleared through our bank, we will pass it on to the parent or person who cares for the child. It is very important that we receive the money quickly as a delay could cause hardship to the children who are entitled to it.
I didn't know you could volunteer for one you have them applied to you, and your employer must take the amount requested from your wages and pay it over to the CSA.
As such I can't see how payments are being missed as the employer would then be breaking the law.
The figures may change as each NRP will have a protected earnings figure ( under CSA1) and they can't be left with less than this under the rules.
Now this means next April that some PWC's will start to get less money when the INcrease in NI comes in if Labour get re-elected:beer: I've paid the CSA off and stopped them taking payments:beer:

All i know is what i am told. He asked if he could pay via a DEO.
As for the protected earnings..ok..fine...but after 18 months of this..1 month nothing then the next month a fraction of the amount (he would send more if he were on benifits which he isnt) and so on...why hasnt he asked for a re assessment if his earnings have suddenly gone down. Just so you know he was originally assessed at a reasonable amount...he complained saying he had changed jobs...then he asked for the DEO...then this. Also for 14 years he has done all he can to avoid paying for our children..so this is why i believe it is another scam.
The CSA have 2 times now gone down the line of sending the warning letters...they send 1...wait 2 weeks...send another..then if nothing is done within 12 weeks they send a face to face officer round to investigate. This process has been done twice but no officer has gone round, this is what i need to complain to my MP about. In the meantime my ex gets further into debt and now he owes me £1000's..so.
Believe me if my ex decided he wanted to see the kids regulary i would drop the CSA like a shot.....he chose to walk away and abandon!0
