Santander Income and Expenditure form

Hi

I became unemployed a month ago and wrote to my credit cards saying that I couldn't meet the minimum payments and could only make a token payment.

I have had phone calls from 2 of them and they were very nice and understanding and have accepted the token payments and frozen interest and charges.

This morning I received a letter from Santander with an expenditure and income form to complete. They have asked me not only to complete the form but to send wage slips, bank statements and statements from other creditors. The form states that "failure to provide the information requested may lead to further action being taken." It also says that I must provide a valid telephone number in order to process the application.

Do I really need to send my bank statements (showing a very unhealthy overdraft) and other credit card statements? I sent the CCCS letter with a summary of my income and expenditure (Debt Remedy) to all my creditors at the weekend, so it has obviously crossed in the post with this letter. Should I have included the full budget summary in my letters, not just the summary?

    You don't have to tell them anything, you don't have to provide a telephone number either. It isn't clear what this is an 'application' for, either.

    Personally, I might fill in the information, but not send everything else, but the CCCS letter seems to cover the matter. Probably, I would write back and refer them to the CCCS letter.

    You are not legally obliged to send it - I am sure someone will post the link (I am terrible, can't figure them out) saying so.

    Write back to them, resending the info as per the CCCS letter, letting them know that you are providing all the information they can legally request. Advise them that you wish to progress the entire matter in writing, as you do not wish to communicate by telephone as verbal agreements can be misrepresented/misremembered, therefore you prefer everything in writing.

    They are swinging it, trying to get your to give them more than you have to. Show them you know what you are doing, and they might just back off a little bit.

    I bloody hate Santander.... so far I know of three complaints that are going to the Ombudsman because of their incompetence.

    You do not have to send them anything, only a judge can request to see such information.

    The only thing that you have to take into consideration is freezing of interest/charges is a goodwill gesture, the choice on if you send them the information requested is entirely upto you.

    I would probably send a covering letter saying you have sought some advice and were recommended to send a statement of affairs that clearly show your current financial position, they may be happy to accept this. If not they may consider applying interest and charges again.

    DVS - the 'application' is in response to my first letter saying that I could not meet5 the minimum payment and is an application for a temporary arrangement. It also says that if the debt is more that £2000 (it is), they may require me "to make an appointment for a telephone discussion with an account manager."

    I'm having a similar problem with one of the major banks, they accepted my CCCS DMP for 6 months and then decided that they would need proof of income to continue with it.

    CCCS reccomended that I didn't send them proof of my income as they had already seen it and the bank where happy to take their word for it 9 months ago, lets face it a debt charity isn't going to lie about a clients income. Plus these companies do not ask for proof of income during an application for credit, they take your word for it.

    Anyway I asked the bank to accept the word of CCCS but they wouldn't and they continue to add charges and interest at an amount that is totally wiping out all of the payments I have made to CCCS in the past 9 months. They also continue to call and txt me daily even after sending the reccomended templates.

    So now I have had to take my case to The FOS.

    BTW this is one of my smallest debts.
