Possible undercharging on mortgage - Pay back required?

HI,

I have a mortgage and due to temporary relocation to another country I have let out my property. This was done with consent to let and an additional 0.5% on my tracker mortgage. Based on the knowledge that on my return I will re inhabit the property.

The 0.5% was applied at the begining of consent. I now need a remortgage as my 3yr tracker is coming to an end. In doing this my mortgage company has discovered (news to me as well) that they may not have applied the additional % for consent to let for over a year.

Since I have paperwork with agreement from my lender for consent to let. A foreign contact address and I have paid the sums they have demanded is it pssible that they have the right to demand back payment for their mistake?

Any advice or info welcome.
