I finally plucked up the courage to call the cccs about my massive debt. The girl was very pleasant but could not seem to offer any advice at all
. I explained that I am self employed but have not even covered expenses in the last 2 years much less have any profit, I owe £47,000 plus £59,000 on my mortgage and was just told to sell my house without trying to negotiate with creditors. The house is worth approx £125,000- I asked her if she thought it would be worth trying to offer a slightly reduced sum in return for a final settlement (maybe 90%-95%) but she said it wasn't worth it as my house is worth enough to cover all of my debt so they will just refuse. I am trying to get any job (absolutely any, i have no false pride :embarasse ) but apparently , as i'm trying to pay everyone back, don't receive any benefits ,have not defaulted on any debt/bill/mortgage for more than a month and would rather not default on my mortgage ever, I haven't got a hope. Basically I was told to stop paying all creditors as ( she actually laughed slightly at this bit ; charitably, i think she was trying to be upbeat rather than laugh at me- i hope so anyway!) they can't have money i don't have. Did I get a slightly not completely clued up one or is this really all there is? If I pay all of my debt my 75 year old mother is going to have to live on an incredibly restricted budget which I don't think is fair as she worked all her life and gets b****r all from the state as it is. I've spent a lot of this debt on keeping both of my parents as their state pensions (including benefits) would honestly mean they would be living with very little heating, electricity or food- they don't have hobbies/social lives or fancy extras.
I was also told that ,once I wrote to my creditors and explained they could have a full settlement if they waited for the house sale , they (especially credit card companies) may panic and go to court to take the sale of my house away from me , sell it for less than the market value and force me to declare bankrupcy. This seems very harsh when I am not trying to hide from any debt. Please, any advice at all would be massively appreciated.

Try going to another service and seeing what they say? What's the other good one called peeps, is it PayPlan or something?0

I'm shocked at the response from CCCS. Try Payplan, I'm sure they will be more helpful and give you more options0

With no particular agenda here but trying to understand what you are saying.
a. you have worked in your business for two yearss without taking any income.
Why?
b. you have run up debts of £47,000 but you have assetts (in your house ) that could pay them off.
You feel it it unreasonable to pay off your debts because........??? you dont say.
c. you have been advice by CCCS that if you had had no assetts and no income you could say to your creditors ...well whatever ...as you couldn't pay them off, but of course you do have assetts.
d. you feel because you have helped your parents that this should be a factor in your creditors view upon your debts.
e. Reasonable, CCCS have adviced you that your creditors may put a charge on your house if they knew you were about to default on your debts to them.
Honestly and truely, it seems to me that
a. you should get a job that actually pays you to work
b. sell the house yourself as you will get a better price than if it is a forced sale, and pay off your debts.
c. make a fresh start

Hi. When CCCS first advised us, we were told that we needed to be able to pay our creditors a minimum of £5 each a month which, in our case, totalled £110. If, as you say, you are not even making enough to cover your expenses, then this is obviously not going to be an option for you.
Have you been paying for everything for your Mum and Dad up until now? Surely they should be entitled to some kind of State Benefit if all they have is their pension.
Is the house in their names or do they live with you?
I think its commendable that you are so devoted to your parents but they will not be around forever and I am sure that they would be very sad to know that you are in such a state worrying over money, especially as a lot of your expenses are going towards supporting them.
Perhaps Payplan could help. But I think you will have to cut your losses and get a job.
Could you post details of your income and expenditure and see where the money is going?0 -
a/ I was trying to pay all bills before allowing myself any money.
b/Yes,this is why i have already stated I am selling my house to pay everything.

e/ Not so reasonably considering I am actually selling my house to pay them, my worry was that they are allowed to take over the sale and let my house go for less than the value.

a/ Trying to get any job,ANY. Please don't tell me there are jobs if you just look as thats not actually true. I am not qualified for the wonderful jobs you apparently are and minimum wage jobs ,at the moment in northern ireland (possibly everywhere) are looking for people to work very part time. I have applied for jobs in factories,offices,shops,care homes and anywhere else I can think of. If you are doubtful I am quite happy to let you know where my nearest jobcentre is and they can confirm I am there every day and will take anything over 30 hours a week (sorry ,but I can't afford to take less) no matter what it is .
