Help needed please

I am new too this site,so havnt a clue on how too use lol,long story short,my ex stopped pay his csa payments over 4 yrs ago,he was told he had too pay £11 pk,i knew myself that his income was much more than he stated too the csa,as we had a morgage together and i had payslips and bank statments from when we seperated,containing all the correct information,the csa said it was insufficiant evidance lol,he still didnt pay csa for several yrs,i phoned the csa constantly and was always fobbed off with excuses,last yr iwas told that they put a freeze on his bank account and recovered £600 or so,i was also told that he had a new morgage soley in his name,and the morgage was of around £120,000 mark,i was furious with the csa because i kept telling them his lifestyle never matched his income,and this was the proof i needed as he would NEVER of been given a morgage of that amount if he was on the income that he stated too the csa,mths had past and i had still not recieved a penny apart from the money that we recovered from the freeze on his bank account,i spoke too a woman from the csa not long after the freeze,and i explained my situation with the whole morgage thing and how he couldnt have a morgage of that amount blar blar blar,and she understood and said that she would look into it!!!! Mths later again a phoned up for info on my case and i was told that they had looked at his earnings and had found out he was earning much much more than he had stated,and he would have too pay £78 pw and it would be backdated since aug 09,mths after i spoke too the lady on the phone !!! why is it only being backdated till then and not from when they can see that his earning was off that amount,after all i had constantley told them of his earnings and made too feel i was a mithering *** ,the debt was now £5000 or so,and still hadnt paid any csa on a regular basis,(about 3 times in 4 yrs ) and he made arrangment after arrangment with the csa too pay his arrears and had failed on every occasion !!!!!,i was also told that they have applied for a court order for him too sell his house, this was dec 09,may 2010 still no court date and the csa are just fobbing me off,its been 6 mths and ime sick off the csa too the back teeth,i dnt know the ins or the outs,dnt know what the csa can do or cant do,ive been told that if there is no equety in his house he will not be made too sell it and he will have too go back too court for a comital too prison,and a judge will either make the decsision too make another arrangment for him too pay( which yet again he will fail) or be sent too prison for 42 days,and after that the debt will still be there but the csa no longer have any leagal right on the debt on which had been accured by that date,my ex would rather go too prison i think,than help towards bring up his son,he doesnt have contact with my child since he was 8wks old,ime a single parent and every little helps,the extra money comes in handy,i wrked full time but had too give up on my job because i could no longer meet all my needs,CAN SOMEONE PLEASE HALP ME ON WHAT I CAN DO,CANT DO,AND THE SAME FOR THE CSA IME AT MY WITTS END THANKS X

Ive just been through similar, I was getting nowhere and felt like pulling my hair out, others on this Forum advised me to go to my MP. which I did, and hey presto, things got moving, Im now just waiting for the money to be paid. Perhaps best thing to do is wait until the election is over then contact your M.P.0

First things first - breathe lol! I realise how utterly frustrating the CSA is and proving income inconsistent with lifestyle is hard to prove and bizarrely the onus is on the PWC to prove it rather than the CSA. So, you had his payslips etc, is he still working for the same company or within the same industry? If he is then the payslips alone are grounds for an appeal.
The fact that they have re-assessed his income and have given you a new payment amount is a step forward, you need to get the debt enforced which is why it will have gone to the enforcement team. If he is already being taken to court because there is no equity in his house then the best you can get out of that is a liability order or a charging order which means when he sells the house you will get your money at that point (I know not a lot of help at this moment in time).
First thing you need to do is get hold of your MP (whoever that may be on Friday and go and complain to them, magically the CSA listens to them!). You need to ask for all of your case records under the data protection act (sticky at the top of the child support forum) so that you can put in a complaint about the way your case has been handled, and ask for compensation due to maladministration. None of this unfortunately is a quick fix, so it will not get you any money in the near future but should in the long run. You've come to the right place for advice, there are many of us who are experiencing problems left right and centre and this is a great source of support.
When you ask for your data protection file, ask for everything, telephone recordings as well. I regret I didn't do this when I requested the info, but have read others did and received them.
Kim...thats interesting what you said about the ex being in the same industry and that the CSA can use the old wage slips in a new assessment. That may be useful to me, thanks!
I too went through my old MP and things got moving. Prior to that I was beating my head against a wall like Rachel is!0
