from sick too holiday?

Hi everyone, quick question.

I'm signed off work till 21st August under work related stress, the thing is i am due to go back on the monday but would only be working till wed as i'm then off on holiday for 3 weeks.

Have been off work for about 6 weeks, very long story though.

Does anyone know if i have to go back to work before going on holiday so i'm entitled to my holiday pay or can i stay being signed off and go straight on to my holiday?

    I don't know for sure but I would say you have to go in, if your sick note does not cover you for those two days.

    Perhaps you could contact them and take the two extra days as annual leave? I can't see how you can call in sick as you've been off for so long and your sick note will have ran out, meaning the doctor deems you fit for work. Or perhaps your doctor will extend it by two days?

    If you're still signed off then I can't see why you can't just take your hols but I would contact them if it were me, just to cover myself.

    Like I said, it's just my thoughts though,

    If you're signed off sick, but you'd got holiday booked, your employer might let you have the annual leave back, as it were. However, depending what your holiday plans are you might need to get your doctor to confirm you are fit for a holiday, IYSWIM.

    If you're not getting full pay any more, and want to get full pay for your two weeks' holiday, then I think that's OK. But you would, as bestpud says, have to go in for those two days, or get your GP to sign you as unfit to work for those two days.

    Certainly if you are signed off sick for a long period you still get your full year's leave entitlement! But it gets complicated if you're off for a full year ...

    Has your G.P. certified you fit to return to work on the 21/08 or does your current sick line happen to expire then?
    Depending on your contract you may be entitled to your annual leave back if you are certified as unfit for work after 21/08 and beyond.

  • I have over 50 staff and I know that you can come back from sick and go straight on A/L -infact sometimes this is better for the employer as it gives you an extra fortnight to 'recover' and you are more likely to be fit for work on your return. Your employer will need you to use some of your A/L up otherwise you may have too much to take later in the year. They may just be greatful that you are taking A/L instead of another 2 weeks paid sick!

    However you will need a sick note for this 2 day period, or alternatively bring your A/L forward or take an additional 2 days A/L

    The company I work for are generally very good - but if I have booked annual leave and then get sick they won't allow me to reclaim the leave. Seems a bit unfair to me.

    In response to the OP I think I would struggle in for the two days (if at all possible) then go on holiday with no added stress about work.

    My old job you had to get a note off the doctor to say that you were fit for work. Of course if you go back for the day (or the two days) that's fine and you didn't need any notes but to go straight from one to the other you were mean to be certified to be well (I think it was to stop people close to the limits of sick leave using annual leave)
