Change of Payment Type

Hi I have just had a change of employer due to my company being transferred to another company all pay and terms have remained the same. I assumed by DEO would be transferred to but just had my first payday and found this was not the case

As soon as I realised the payment had not been taken I got straight on the phone to CSA and informed them I would make a payment via Standing Order, they agreed finally after trying to coerce me to make payments via credit card instead !! this payment has been sent today.

I have also asked them to move to standing order payments on a permanant basis, they have agreed but kept asking me to give them my employer details first before agreeing to the standing order payment schedule. I have asked them to send this request in writing as I really want to agree payment via standing order before providing them with employer details.

I get the feeling they are just saying yes to keep me quiet and the minute I provide them with the employers name and address they will go direct with a DEO

Questions

1 ) Is it a legal requirement to provide them with my employers name and address if they have agreed to allow me to pay by standing order

2) If yes, is it possible to delay this until I can get me standing order schedule set up

3) What are my chances of getting this is writing before giving them the employers details

Any advice would be most appreciated

    DEO is usually set up if you have had arrears. Have you cleared the arrears? If not then the CSA is entitled to ask for another DEO without recourse to yourself, if you have cleared them then you can pay by standing order.

    Bear in mind that if you refuse to give them your employers details then technically they say that you are being non-compliant and pass it onto their enforcement team. All calls are recorded so if you have already rung them and have the name of the person that you spoke to there should be no issue.

    What you could do, is set up the SO, then write to them with the details as it takes them at least 3 weeks to set up a DEO by which time the first payment will have reached them, so there would be no point in imposing a DEO.

    Thanks Kimitatsu, I have no arrears other than this month which have only arisen due to my employer change which was not of my doing. I have paid an interim amount which they have agreed to and have advised them I will pay the remainder of this months money with the May payment which they also said was ok.

    I have not refused to give them my employer details at present I have just told them to send me a form to fill in. I would just like to delay giving them the details until I have my standing order in place, the strange thing was the lady on the phone said she would not issue the Payment Schedule for a standing order until she had my new employer details ?? why would they do this if they are not planning to go ahead with a DEO anyway

    Have you had a change in salary at all? That may be why they need your employer details as a change of circumstances can trigger a re-asseement of the case.

    More likely is the fact that they cannot issue a payment schedule without your employers details as the computer will not allow them to!!

    If you have just changed employer though and your salary has not increased or decreased significantly then I would just send them your normal payment so that you do not accrue arrears. Is your assessment before 2003? If not it will be a straight percentage of your salary so you should be able to work it out yourself.

    No change is salary or terms of any kind it is a straight transfer. I have already made payment of the agreed interim amount and will pay them my regular amount plus the balance of this month (also agreed with them on the phone) at the end of the month. Therefore there will be no arrears

    I am on the old rules (CSA1) therefore not a straightforward % however not a problem as I have the old collection schedule and will just use this to make the payments for now
