I had a letter from Gateshead Court asking for my offer of payment regarding a payment of a debt. I fully acknowledged i owed the full amount and made an offer i could afford.
The hearing was held with none of us present and they rejected my offer and are now demanding the full amount - I obviously can't afford this or would have paid it!!! at the bottom of the court letter i have just received it says if not paid debt collectors will come to my house to collect goods to the value - what do i do i have 6 days to respond now!!
Please advise - am really worried - its not as if i have denied owing the money at all!!

Ring the court and ask if you can appeal? Maybe having a hearing where you are there in person would help as they will be able to see that you are genuine?

Have just read somewhere that i can appeal to the court in writing, as the creditor has asked for the whole amount back in full - which reading on means they really are trying to secure the debt against my house!
How successful are they in doing this? Are the courts flexible enough to turn to the creditor and say, accept her offer?:T0 -

What sort of debt is it? Why weren't you represented at the court? I understood that you had this right and also that courts usually accept minimum payments if they know you are genuine - things like council tax debt or inland revenue debt are different though.0

Definitely appeal then but make sure you take a complete budget to the hearing (with copies for the judge and the creditors). Show what extra you are doing to try and manage your finances and be as reasonable as possible. Be polite. You have nothing to lose (except the court may have to add a few more costs to the total but it would be worth it)
Keep us posted and act quickly!

How much is this debt for? who is the lender? what did you offer to repay?
a lot will depend on value and whether you appear as to whether they will secure debt against your home. If they want to do that then they have top ask the court speciffically for that. I would complete the forms and ask for a hearing. What you have described so far is a paper exercise and neither side are represented the court puts your offer to the lender who has declined it. Now you must ask for a hearing before a district jusge who will make a decision.
prepare and income and expenditure form and be realistic in what you can repay. No court will order you to pay more than you can afford. Relax the judge will be fine and you will get your say. Chances are teh lender will end up accepting what you originally offered.0
