case closed for seven years now they need arrears

In November 2003, th csa closed my husband case. In november 2009 the demanded arrears of over £11.000. We had already paid £9000. Iasked for a breakdaown found he only owd £1950. That was a relief. I am wonderign if there is a time limitation on paying the arrears.
His children are now 29 and 32.

They have this 2 year period which is not law, but they try implement. Also on a DEO they can take up to 40%, but not sure if they would do this with the majority already paid.

my daughter is 25 and had similar problems. They came up with some outrageous figure, but have yet to reduce it.

My ex wasn't paying and the CSA told me that there was no time limit on the arrears. My daughter was, at the time, only a few weeks away from leqaving sixth form. I thought that i would only get the arrears for the two younger children, but the CSA said that even if all of the children reached adulthood before they caught up with him, arrears always have to be paid.

They caught up with him a few weeks later and he is now paying those arrears. My daughter has been working for about six months.

The CSA do try to collect any arrears over a maximum of two years, but this is not law. There is a set amount that they have to leave you to live on, by law. So when, for example, my ex was off sick and only receiving SSP, his payments were lower that month. This means that it takes longer to pay off the arrears though.

If he is now repaying arrears, the amount they can take is 40% of his net income - if that takes over 2 years, they may decide to take other action too, such as get a liability order in court if they were after July 2000 and then take enforcement action.

There is no time limit on the arrears as they are not time-barred like other debts, the statute of limitations does not apply to debts after July 2000 - debt before that cannot be enforced via courts but can still be collected via a DEO for the non-self employed.
