Has my Agreement been Terminated?

Hi have a card with Argos Card Services. I was behind with repayments, they sent me a DN which is invalid. Moorcroft have sent me a letter asking me to pay the full balance or call them to set up a repayment plan in the next 7 days.

Does this mean the agreement has been cancelled with Argos?

    Have Moorcroft sent you a notice of assignment( i think its called that)

    Don't call Moorcroft, send them the "prove it" letter

    No notice of assignment yet, just a letter from their infamous Pre Litigation Department.

    Is it terminated then?

    i had the same but they didnt send me a default notice they just defaulted me. first i knew was when moorcroft sent letter telling me (not asking)to stop paying argos, as they have bought the debt. it was less than a month behind ( a months payment 50.00 i was 25 .00 behind ) so i guess yes they have cancelled your agreement with argos.

    how old is your debt? if you can i would have a look at never in doubts thread on unenforceability, as he wrote a great letter for me to argos and moorcroft about how the default was invalid. as of now i have had no responce from argos but i have off moorcroft who are not going to persue for payment until this mess is sorted. hope this helps :)

    I have CCa'd them last year and they sent a original copy of the agreement. I just wanted to confirm the termination as I can then accept their unlawful recession thus only owing the arrears.

    If so it will be 3 out 3 debts so far that have been terminated on the back of a dodgy DN.

    and well done you :T hope it has been defaulted for you lol as far as i am aware once moorcroft have their mits on the account it has been terminated maybe you should wait to see what moorcroft send you after the 7 days good luck anyway :D

    Thanks. The 7 days passed last Thursday and the phone calls started Friday. So I expect a letter next week.

    Once you are asked to pay the balance in full, you could deem the agreement terminated, as they have removed the right to pay in installments. Also if the debt is sold (absolute, not equitable right) or litigation commences.
