    Don't know what relevance 'our kinsman in a turban' is If you sign a loan agreement for me I will stand on one foot sticking my tongue out - just if you sign today of course.

    To be serious again - who did you take out the contract with? Was it Everest LTD the company or a self employed rep (never mind the finance for now)?
    If it was Everest Ltd it is they who you should deal with your complaint about the deal - the 2 year free side.
    Write a letter of complaint - if you have legal assistance on your home or car insurance - use it to get free advice.

    As for the finance deal you have to pay Barclays what you signed for on the loan document.
    This is the part you will not like but Barclays supplied the finance only and had no part in forming the contract between you and Everest.

    Any compensation needs to come from Everest unless it was a self employed rep - in that case you are well and truly stuffed.
  • I hope you have been told by now to contact the financial ombudsman
    Service. On their site you will see they have dealt with at least 10 such cases of misselling in the past year. Now that the FOS publishes all its decisions it is interesting to see that almost all of these dreadful cases are upheld and the company has been ordered to refund the difference between the quoted cash price and what people paid via the finance deal. Make sure that you follow the FOS advice which first means contacting the company and getting their decision. Then when you construct your claim it is vital to be as clear as possible about what happened when the salesperson sold you the deal - difficult I know as most of these arrangements are as clear as mud! Also be clear about what you think you should be refunded and provide whatever evidence you can. If in any doubt phone them up as they are very helpful. Good luck - just remember others have been through the same and been refunded so if you have a good case and present it well you should get the appropriate help. I know how terribly stressful it is so I wish you all the very best with getting your money back.

    Just had an everest sales rep round last night - ignoring the fact his first quote was £32k (last firm quoted me 7.5k!!) I was absolutely disgusted by the pressure to take the Barclays finance deal. I repeatedly stated I wanted to pay the full amount, but he told me I would get a better deal on finance, even suggesting that the only way to get a full garantee was to take the finance. I then spotted the 25.1% apr on the loan example form and as soon as I asked about it he actually covered it with his hand and said "don't worry about that, it makes no difference" (!!!) I then asked him to be clear and tell me if he was offering me an interest free loan. After a lot of dodging attempts he admitted that he wasn't. When I challenged him he told me I, like many people, got confused over apr rates, basically telling me I was an idiot. That was when I told him to sling his hook - absolute con merchants! His final offer was 17k which I worked out would mean if I took the full 10 years to pay off the finance I would pay 26k in interest! No wonder he wasn't interested in taking cash for the full amount, clearly they get a healthy kick back off Barclays. I feel very sorry for anyone caught by this scam, the sales patter, whilst convincing at times, amounts to criminal fraud in my opinion.

    I'd make a complaint to trading standards if I were you, just think the next appointment he had could have been a frail old pensioner who would sign up under pressure just to get rid of them.

    Consumer credit comes under the remit of the FCA in April. So hopefully the whole issue of unsecured credit will be reviewed in the same manner as secured credit (Mortgage Market Review) has been. You would have thought that behaviour like this would have been outlaws years ago. Really no different to the banks misselling PPi.
  • It's taken me 2-3 years but the Ombusdsman, after appeal, just made Everest repay me all lost interest paid, and interest on the interest, for a mis-sold Everest (Barclays Home Finance Agreement)....I signed up for 120 months thinking it was for 24 months. Even 24 months was mis-sold.

    Hi everyone I am just at the start of taking on Everest as I took one of these loans out five years ago and have paid over £9,000 and the settlement amount is £5,800 on a £7,340 loan! I believed this was the term of the loan but it is 120 months. I have spoken to Barclays today who have escalated my claim but have advised me to contact Everest which is my next task.
    I believed the loan would be paid off in five years and was told by the very aggressive saleman this was a 0% deal and very competitive.
    Any advice when contacting Everest? I spoke with them a couple of years ago but they said the issue was with Barclay's and not them and the salesman had left their firm, foolishly I did not continue with it. Barclays want lots more money and say it is Everest. I don't consider myself to be a stupid person but feel well and truly duped by this lot.

    Any help would be welcome thank you

    Have you got your copy of the loan agreement? if not your first step needs to be to obtain a copy of the agreement.     Yes I have a copy of the agreement and bits of paper that were written on- Barclays are sending me a copy as well. I need to find all my documents as I had intended to pay off today but could not believe how much it would work out as Barclays also want a months interest. I truly believed the loan was for five years......
