Help! (Newbie needs some advice)

Hi

I owe money (nearly £2000) on a credit card and as I had to give up work due to ill health, so could not afford the reduced repayments as I am now on benefits. When I was with the card company I told them that the £50 a month I was paying them was going to have to be reduced as I was no longer in work and they just said to pay what I could afford, that being £15 a month. The card company then sold my debt to Capquest and I agreed with them to pay back £1 a month (even though they wanted more and to set up a direct debit from my bank I said no, as I felt that it is better to pay too little than too much)

I have paid the money every month, but today they are insisting that I have made no payments since Jan 23rd, which I have and have the cheque stubbs and bank statements to prove it. I have just got off the phone to them (they were rather intimidating at the least and wanted to yet another income expenditure form sent in etc.)

I suppose what I am really asking is, can anyone advise me on how to stop Capquest from sending me these letters, or is there anyone that I can complain to, as the information that they have regarding my account with them seems to be wrong.

    First thing, stop phoning them. DCAs routinely bully and lie on the phone. The letter is probaly just computer generated; it is common place for peopel to recieve similar documents when paying far more then you.

    WRITE registered post with with the dates of your cheques, dates they were cleared from your account and demand an explanation as to why that have lost the payments?

    When did you take this card out?

    The card was taken out in 1997 - 1998ish. When I found out that I was unfit for work I asked the card company if there was any payment insurance that I could claim on. Unfortunately it was an overseas call centre and I don't think that they understood what I wanted. They did tell me to continue making regular payments (which I did), so I cannot understand how it got passed on to Capquest.

    Hi dawby,
    Have a look on the unenforcability thread by never-in-doubt. There you will find advice and template letters to help stop CrapQuest giving you hassle. It may even be that the origanal card agreement was flawed. There are people on this site that will help you check this.

    CrapQuest like all DCA's (debt collecting agencys) ride roughshod over people and rely on fear and ignorance in order to extort payment.

    If you had not made any payments to the account it would now be statute barred. As you have tried to do the right thing even by making token payments you still have certain avenues you can explore.

    You should have been informed by the card company that they had sold on the debt or passed it to CrapQuest to administer.

    niddy will explain it better than me, but it seems the first thing to do is a CCA request. If the account was opened in 97 I dont believe that they will be able to comply, and that will but you in control of the situation.
