Child Tax Credits - Kellogs

Hi can anybody help me with my CSA1 case. I have spoken with the CSA yesterday after receiving a letter asking me to tell them if my partner receives child tax credit for our two children.
When i asked about this they said that i didn't legally have to provide them with this information - is this correct?
Also to Kellogs i sent you a PM the other day asking who this would affect my previous calculation if the tax credits were included. I have a feeling that this would mean i would have to pay the assessment of £85 would it be possible for you to confirm this for me?

Whilst you don't legally have to provide the info, if you don't they can't finish the calculation and you may end up with an IMA as they won't be able to calculate your household income. That will lead to no protected income, which means you will pay the full amount rather than a possibly reduced amount.
I need to check if working tax credits are only added to the household net income figure, or if it is added to the net income of the NRP if they are the main earner - I can't remember!! There is a difference between the way that child tax credits and working tax credits are treated.0 -
Many thanks for your help. I think this now transpires that approximately £25 (about half) of our tax credits for our children will be going to my first child. As you can imagine my current partner is very displeased with this.
This also means that will be paying £40 per week more than if i was on either CSA2 or the new, new system. What makes things harder to take is that for years i have asked why i can not be on this new system and the reply was because of the computer system. I have now been transferred to the new computer system yet my calculations are still based on the CSA1 system.
When i asked the CSA about this they recommended that i move out and get my partner to claim for our child so that both cases will be assessed under the new rules!!0 -
The computer system is separate - it is called CS2 but whether your case is on new rules or old is simply because it can't cope with full migration - so the Government decided to scrap the original plan to switch all cases over. Too many cases were getting stuck, too many glitches in the system which keep coming up made it impossible. Basically it wasn't fit for purpose, yet still EDS get the contracts (NHS etc, they clearly don't learn). You can only get onto CS2 rules if you have a new claim against you or the old case is closed, a wait of 13 weeks is applied and then a new claim made.0
