Car finance trouble (shock)

I recently (2 days ago) brought a car on finance from "Carcraft" , I came to an agreement with the sales clerk that I could trade in my old car which had no M.O.T. for a new one, a problem soon came up though because i needed to transfer my private number plates off my old car on to my new one, but I needed a current M.O.T. certificate to do it, the sales clerk, obviously desperate to make a sale, said that Carcraft would foot the bill of the M.O.T. and of any work that needed doing as long as I brought the new car, which I did.

Once I had got the new car and had signed all the doc's I left thinking I had a fair deal, but 2 hours later I had a phone call to clear a £190 M.O.T bill! after hours of trying to speak to management to sort it out etc, I decided that due to the way I was being treated, and due to the fact that they had gone back on their side of the deal, I would cancel the contract (it had not yet even been 24 hours) so I tried to speak to a manager but I was hit with a wall of excuses as to why I could not speak to him, I came to the conclusion they were probably just stalling so that the contract would authorise and go through.

So today I went back to Carcraft and demanded to see a senior member of staff so I could express my concerns and so on. After an hour or so and after being told "there was no one currently on duty" I finally got to meet the floor manager, to be fair he was a nice guy, he basically told me I was screwed as far a the cancelling the finance was concerned (even though the finance company,Barclays, said if they received a cancellation of the contract then they would be happy for me to return the car and for the finance to be cancelled) but Carcraft flat out refused to cancel it.

Long story short I was then offered the original deal, of them sorting the M.O.T, but I couldn't cancel the contract. I thought that was fair enough and again left feeling I had salvaged some sort of an "ok" deal, but 2 hours later I received another phone call from Carcraft again, this time saying I owed them £290! Then the manager said that I would at least have to pay the extra £100 for the M.O.T. I again declined the offer to which they then said "well what about £50?" again I declined and refused.

Once I got home I again contacted my finance and basically said I would refuse to pay, I was expecting a threat of court or something similar but they were pretty fair and just said that I should first try and persuade Carcraft to cancel the agreement, but it is becoming clear their is more chance of me !!!!!!!! rainbow sherbert! so I really just need some advice on what I can do next, and on what rights I have? it has come the point where I would rather go to court and deal with it there, because I'm sure that somewhere I have been treated unjustly, any help would be greatly appreciated.
Its worth noting that I did try and cancel the agreement with carcraft before it had been authorised by the finance company, but I spent the whole day waiting for a phone call from the manager of carcraft so that I could arrange it, when I later phone up and finally got through they said there was nobody who was authorised to clear my request as the manager had gone home and hence pushing the contract into authorisation.

  • I would write to them recorded delivery pointing out what you were origanally told about the mot,tell them that you are not prepared to pay for it and that if they wish they can take you to court.

    Do you have it written in writing that they would foot the bill of the MOT?

    If not I doubt you stand much chance of succeeding cause it will obviously be your word against theirs.
