    BCD - your conviction is spent. That means that although it will appear on an enhanced CRB it will not be taken account of.

    Because you were under 18 your rehabillitation time is reduced to either 12 months or the end of the order whichever came soonest.

    You cannot ask for your CRB check off your own bat, but you will be sent a copy of it when it is done so can see how it is recorded then. If you choose to you can forewarn the uni of the possibility by giving them details in a sealed envelope which will only be opened if they want to offer you a place, but to be honest I dont think I would worry too much. They will come and ask questions if they think it is an issue.

    Jobs where you work with children and vulnerable adults are exempt from the Rehabilitation of Offenders Act so it's very sweeping and over optimistic to say that nobody will take account of it!

    I think it perfectly possible that the OP will be ok on this score but it isn't as simple as you're trying to make out.

    Then the decision should be made rather than just on the face of the CRB. Sorry - its been a looooong week!

    No, but see below, and you can get a copy of your criminal record by a Subject Access Request under the Data Protection Act. See this link from my local police website, I don't know if you'd have to go to the force where this happened, or if your local force (if different) would know about anything that happened anywhere else.     There are two potential problems with this.

    1, It is possible that the employer / organisation requesting the check will be sent more information than is on your copy of the disclosure. Ian Huntley is a prime example of why this could or should happen: he'd never been convicted of anything, but there were reasons to be concerned about him which weren't passed on from one police force to another. This information is passed on in strict confidence: the employer isn't allowed to tell you that it's there, but may of course feel it's sufficient reason not to employ you.

    2. By the time you get your copy of the CRB disclosure, it's too late, the employer / organisation will have theirs. So if there IS something you knew about but didn't 'disclose' and it's on your copy, or if there's something you knew about but didn't 'disclose' and it's NOT on your copy but it is on theirs, it looks as if you're trying to hide something.

    I'm sure the NACRO site has information about what you should do in this situation. Where I work we invite people to submit a sealed envelope with their application form, and I think something similar should happen with applications to courses. That way, your 'interesting' past doesn't come under widespread scrutiny but is only known about by those who need to know, and you get the chance to explain how / why / when it happened and that you've changed beyond recognition. At the same time, it doesn't look as if you are trying to hide something.

    Given the very high percentage of young people who do have a criminal record of some kind, I would encourage you not to lose sleep over this. But finding out if anything shows up on a Subject Access Request would probably clarify the matter in your own mind.

  • A bindover order is not like a proper conviction or even an admission of guilt. It was a way of disposal before going to trial. I process enhanced CRB forms due to my job, the top part of the form says list of Cautions, Convictions, Final Warnings, Reprimands.

    If the bindover was fairly recent it might appear on the additional information part but this in my career I've only seen once for someone accussed of a serious offence.

    I would be honest with whoever is submitting the CRB form (NHS? Uni?) and let them know your concerns and that you would like an informal chat about it. If nothing comes back then you know for the future. If the information does come back then at least they know about it, have met you and know that your not a violent thug who is going to beat people up with radiography equipment.

    The cases of Vanessa George and Peter Harvey show up the futility of CRB checks in trying to determine future events and 'suitability' for employment in certain areas.

    However, there are millions of small minded, bigoted, holier-than-thous out there who really get off on judging you for your past.

    You may get on your course but not get a job. It all depends on whoever makes the decision and what kind of person they are. It could mean years of wasted study, or you could sail right through.

    Make no mistake though, this will rise up and bite you on the !!!! up until the day you die.

    No, as others have said you can't apply for an enhanced CRB yourself.

    The charge may show up, it may not. And for all this board can speculate, comment and advise based on our own professional experience, individual experience or what we heard down the pub from a friend of a friend until you have the check in your hand you simply won't know.

    Of course if, between now and when you plan to apply, you were considering expanding your CV by doing some voluntary work then some charities would need to carry out a check on your behalf. They would get a copy, you would get a copy. Before you applied for the course.

    There would be a cost to the charity, both in financial and administrative costs, so to keep your conscience clear you'd need to actually doing sufficient work with them to at least compensate them for that. Hopefully anyone going down this route would feel a moral obligation to put really rather a lot back into an organisation that provided them with a way through this.
