Car Query

I'm disabled and I think I'm about to get made redunant

However I have a mobility vehicle which the OR was ok about because I needed it for work

People who know me on here will know I am particlly house bound without my car as I can't walk

My question is If I loose my job is the OR going to make me give my car back and claim the benefit in cash instread?

    Hi curly, I would be very surprised if the OR takes your car from you. As you need it to get shopping etc and to be able to seek further employment this is essential for you. Hopefully someone in a similar position can help and maybe Debtinfo can clarify this for you x

    Scared - really scared!

    everything is just getting to me at the moment and the last thing I need is to be house bound!

  • i cannot see why the OR would possibly make you do this.The cash that you would get instead from the mobility would be of no benefit to the OR because they cannot touch this money.It is given to you because you need it by the DWP.My son is disabled and i dont work and i got to keep my car.It isnt a mobility car,it is my own that i purchased with my sons mobility money and i was worried the same as you,but he said they are not in the habit of taking vehicles from people who need them because of disability.Did you not get an excemption letter for the vehicle ???

    I got nothing like that of the OR but I got one of Mobility advising they have been advised of my BR and they are not happy but they are not going to take the car back at this stage

  • Curly, your DLA is for expenses incurred due to your disability. If the OR was to make you give back your car then the mobility component of your DLA which now pays for your car would be needed for taxi's and other support for you to get around. So making you give up your car would be pointless to them.

    Additionally if you lost your job and were relying soley on benefits then you would not be liable for an IPA anyway.

    Sorry to hear about your possible redundancy, this must be worrying enough without worrying about losing your car too.
  • Do you pay an ipa at the moment hun?? If the worse does happen and you do get made redundant then all you are required to do is let the OR know your change of income.I wouldnt even mention the car and if after your redundancy you are going to be living solely on benefits then you wont be required to pay an IPA so cant see them being too interested to be honest.Hope it all works out ok for you and please try not too worry all though i know thats easier said than done

    Hi curly, I am presuming that your are on the 3 year contract hire mobility scheme. (most people are, its a bit different if you are on a HP scheme instead)

    The car is at all times owned by the mobility scheme, therefore it is not an asset in the bankruptcy, therefore you wont get an exemption letter (you cant exempt something that isnt an asset in the first place) and therefore the OR will never have a claim on it whether you are working or not.

    The motability schemem may grumble a bit but i have never seen a case where they take a car away, afterall they are guaranteed payment from your DLA.
