Can I take my tax office to Small Claims Court?

  • Go and sit inside your local tax office until they give you the refund. Explain to everyone who comes in why you are there. Invite the local press to come and interview you.

    No, this would not work.

:rotfl:You best make an appointment first via the call centre and make sure you take two forms of identification. You might have quite a journey to get to your local HMRC office as most of the smaller ones have either been closed or are on reduced opening hours.

With the current problems involving tax codes at the moment it's highly unlikely you would get through on the phone and the enquiry centres don't have facilities for making refunds, no matter how long you sit in protest.
However why don't you take it up with your local MP and ask him how his party intends to fix the current mess that is affecting many of HMRC's "customers".

It can be and should be. I haven't dealt directly with inland revenue but my girlfriend is currently a victim of their incompetence, which seems to be in line with that of the council tax department with my local council. Basically far too many people have one little job to do and so there is so many details to handover to the next person that there is no cohesion or "joined-up thinking" bout a case. Only the simplest queries can be dealt with anywhere near efficiently. The whole shebang needs to be "slashed and burned" as you put it, or modernised as I like to put it. I honestly believe half the amount of people could do a far better job in my council tax department and from what I've seen it's the same with the tax office

Then vote for the party willing to do it, then see what the whole system is like in 4 years time. I can guarantee it will be a whole lot worse.

The problem is all those on the front line know what the problems are, and many have very good ideas on how it can be rectified, but the majority of those in charge of HMRC have no tax knowledge what so ever, they have been brought in from the financial sector to run the 'business' as a business. I does not work.

What needs to happen is they slash the jobs at the upper level, there are too manby chiefs and not enough indians.

Slash the positions that are not needed, and with the salary savings bring in more front line staff to deal with customers.

Also, calling those who work at the tax office (on the front line) inadequate is unfair. These people work hard, for very little reward, with processes changing often from week to week, with computer systems that are a law unto themselves, and pretty much terrible working conditions.
