Hi all. First post, so I'll keep it brief. I hope someone can help with even the briefest answer.
I was mis-sold a car loan for over £25,000 that my broker set up with Lombard as a variable interest, balanced payments loan. Lombard subsequently changed the agreement to a fixed rate, non regulated (by CCA) loan, and have now informed me that after two years, I have only paid off the interest, none of the original sum. Indeed, I did sign the agreement - which I should have checked more carefully. Under it's terms, I'm thousands of pounds short on the actual value of the car - the reason I never wanted a fixed rate, penalty filled loan in the first place.
However, my broker tells me that as I signed it on the 18th April 2008, after the 6th April 2008 deadline on the new CCA, the loan is unenforceable and they have to refund the payments. Can anyone confirm this? When I asked Lombard, they were very evasive, and offered to reduced my settlement figure by £3500, so clearly they recognise something was wrong with the agreement.
Any help, even a legal contact to confirm this would be greatly appreciated. Thank you for taking the time to read this.
