Argos 'new' Ipod touch

I purchased this Ipod touch, a couple of weeks ago, when Argos had a special deal on it, for my husbands birthday. I thought that I was buying a 3rd generation Ipod as it states that it is new. It is in fact a second generation Ipod that Argos are claiming is new. My husband has checked out the serial number with Apple and they confirm that it is a second generation one. My husband tried to take it back to Argos and they actually told him that they have had loads of complaints about this, but would not do anything about it as it is exempt from their 30 day money back guarantee and they hadnt actually stated what generation it was. This has really put me off shopping in Argos as it is very misleading, especially as they are charging 3rd generation prices for them!!!!!

    That is really naughty, especially knowing that many of their customers will be people buying them as gifts, who may not necessarily be very knowledgeable themselves (parents buying for kids etc).

    I'd be tempted to pursue it, surely the use of the word "New" is misleading when there is a newer version of the same product available on the market? I'm not great at the legal stuff though sorry, just my opinion!

    I got a 3rd Generation Ipod Touch in December!

    I would go to Apple about this. They are obviously selling old stock.

    Why not go on the macrumors forum just to find out exactly when 2nd Gen and 3rd gen were being sold?

    I thought the 8GB iPod Touch 3rd Gen was exactly the same as the 2nd Gen. Specs only got improved in the higher capacity models.

    The £149 8GB iPod touch model, on the other hand, is just the equivalent of the iPhone 3G-a collection of year-old technology that's been kept around to be sold at a bargain price.

    Just because it is an older model, it is still 'new', as in not second-hand.

    But if they were saying 'new' as in 'new model', then I think you've got grounds for complaint.

    The Argos add clearly states:
    NEW Apple iPod Touch 8GB


    It could not have been a 3rd Gen as it states 8GB. 3rd Gen are only available as 32 or 64GB

  • I'm not sure you have much ground for complaint. When Apple launched the 32Gb and 64Gb iPod Touch in September last year, they launched a refreshed 8Gb which has software updates on it. It's always been sold alongside the true 3rd generation models, even in Apple stores, where the displays don't specifically mention it isn't strictly the same.

    I'd imagine this Argos one is one of the ones after September 2009, so it is a new model 8Gb iPod touch.

    What are you missing from this that you would get in a 32Gb 3rd generation one apart from 24Gb of space? The differences aren't that great.

    And the price looks pretty much in line with everywhere else.

    whats even more confusing is Amazon sell a 8gb using the words

    "New Apple iPod touch 8GB Latest version (Launched Sept 2009)"

    Apart from the bit where it doesn't say "only".

    The 8GB model was re-introduced alongside the 3rd generation iPod touch in September 2009, and included the newer iPhone OS 3.

    As I said in the other post, they also refreshed the 8Gb model at the same time, and it is sold alongside the 32 and 64Gb in Apple stores, both bricks and mortar and online. You simply can't get an 8Gb iPod touch that is truly 3rd generation. But you can get a 8Gb iPod touch that has update software, and these are normally termed "new".

    Oh there is definitely a difference, the 3rd gen 32 and 64gb touches have the same internals as the iphone 3gs and are a lot faster.

    Actually, if you look at the webpage for the 32, it even states
    Faster performance (32GB and 64GB only).
    Voice Control (32GB and 64GB only).
    Apple earphones with remote and mic (32GB and 64GB only).

    and as you said, on the page for the 8gb, as well as the other two it says
    iPod touch 3.1 software.

    Without going to wikipedia, if you go to the main apple website, they don't sell a 3rd gen 8 gb touch
