complicated question...

My OH has about £10K worth of debt which is in the middle of arranging a DMP with CCCS.

He's been charged unbelievable amounts of late payment charges and interest by all 3 credit cards (which is actually the reason that his debt has not gone down at all in the last 10 months even though he's paid about £3000!).

My question is; will he have to wait until he's paid the debts off before reclaiming the fees or can he do this now? It is advisable to do it now?

Also, he was pressured into taking the PPI on all 3 cards and it was useless to him as he was a student at the time! I cancelled these a couple of months ago but I wondered if I could claim back the PPI fees as well by explaining that it was totally unsuited to him and he would never have been able to put a claim in? Just a thought.

    Not at all an expert but I'm sure I've seen the answers to both on here before and think they are yes, claim now and yes, tell them you want it back. Maybe if you do a search or look through some threads you will find someone who knows more about it and gave the answers!

  • Hi there, there is a thread somewhere on here with a link to a model letter for cancelling and claiming back PPI. Do a search and it should pop up somewhere.

    Yes claim them now - although your OH is still admitting part of the debt so he could start making the repayments on that whilst not admitting any liablity for the disputed part of the debt.

    Sorry EllieB, could you please clarify that for us stoopid people please? ;) Do you mean that he is paying off the credit card debt but will be disputing the charges?

    The PPI was on Credit Cards, not loans, which as none of you have queried, I assume it's still ok to claim the charges back?
