Hi again everyone.
I was just looking at one of the previous letters from the company they are called "Rossendales" and it says on it "Magistrates Liability Order/Distress Warrant" but it is on Rossendales headed paper so surely this is not a Liability Order as I have the actual liability order that was placed on my Dad and it is from Liverpool City Council.
Help0 -
I think the council has to get the liability order, but they can then issue the warrant to bailiffs to collect it. One of the ex-bailiffs on the forum or those who work in council tax can probably confirm it.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0 -
The council will have obtained a liability order against you in order to be able to instruct bailiffs - for that is who they are, not debt collectors. I say that not to be picky but because it explains a lot of why they act they way they do.
The bailiffs will continue to act to enforce the debt as instructed by the council until they are told to stop doing so by the council. Some reasonable bailiff companies may be prepared to delay enforcement to give things time to get sorted out when a clear error appears to have taken place, but not all of them are reasonable. In their defence (can't believe I'm saying that) they do hear all kinds of crazy stories from people who do owe the money and don't want to pay, so ignoring what the debtor claims and only going on instructions from the council does make sense from one point of view.
You can (and should) explain the issue in writing to Rossendales, but I would also suggest that the council who they are acting for should be your main plan of attack. If you don't stand for something, you'll fall for anything0 -
Ok thank you very much I'm sending whatever I send to Rossendales to the Council too!0

One more thing sorry, so the bit I said in the letter about them not being able to come into my property is untrue then? Can they just come in whenever they want?0

Have the bailiffs been inside the house yet, have they levied any goods?Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

If the answers to Dark Convict's questions are "no and no", then the answers to your last post are then also "no and no".
If you answer anything else then we'll need to know what exactly has happened in that regard. If you don't stand for something, you'll fall for anything0
