Can the BPI, or anyone else, RELIABLY tell the difference between legal downloading or file-sharing of music, and illegal?

If the music isn't covered by copyright, and hasn't been published anywhere, and I file-shared a lot of it, would I be illegally file-sharing in the eyes of the BPI?

In a nutshell ...Sell cheap, sell more, everyone is happy.Sell overpriced, people will bypass you, you go into denial and run around in circles with copyright protection, legal battles, and web site closures all of which is futile and again bypassed, a waste of time and money, money being your primary concern, and you are seen as a profiteering bully, while the public are criminalised when they avoid your over pricing and choose to download for free.

Radiohead sold 1.2 million copies of their album 'In Rainbows' by allowing people to choose how much to pay for the download. The way forward, I feel.

And how would you feel if an arguement was raging on that you, as an NHS worker, should not be paid for your work? And instead should work for free? And listen to thousands of people arguing that you SHOULD work for free?

I would rather give my money any day to the workers of the NHS, the emergency services and the army than to artists such as yourselves who are going around and assuming that everyone downloads music illegally. Not a great start if your trying to become a musician and gain fans. I would not buy an album off 1 song, have done a couple of times and been disapointed, if musicians such as yourselves gave us a chance of listening to your music before buying it then I for one would be more likely to buy.

Oh and before you assume anything no I don't download illegally.
  • Hi all,

THanks for all your questions. We've sent the questions to the BPI and will be publishing the answers in an article very soon.

    Cheers

But they havent said how much they made, i bet it was less than if they had released it properly.

Test will be what they do next time!

I've been wondering why so few places offer chart music in FLAC format. Why is that?

If I buy the CD, rip it to FLAC and then sell the CD is that illegal? I know it's bad for music sales. Once I've ripped the CD I don't want it so the temptation is to get rid of the clutter and get some money back! So offer FLAC downloads and I'm all legal and the people that make the music get more of my money!

After all it's the 21st century so maybe we should be listening to music at CD quality. Or maybe better, 24 bit FLAC, 24/192, etc. We first saw CD in the 80s so maybe 25 years on we should be listening to something better than CD and not worse, which mp3 is.
