    Sorry I am a bit naïve to all of this - I've only just turned 21 and the only advice I've really received is from Google and here

    Your solicitors do not seem to be doing their job here, ask them what the hell is going on.

    Doesnt even go in front of a judge. Just rubber stamped.

    OP if your solicitors are on record as acting for you with the court then notices abotu hearings etc would go to solicitors not you. No defence = no hearing.

    What do your solicitors say about proving that the uni received letter?

    Did you receive a withdrawal confirmation from your university?
    Did you inform the LEA that you were no longer attending your course?
    Did you receive a letter from your LEA stating that you'd withdrawn from your course?

    Hi MrsManda - No I didn't receive any sort of confirmation apart from verbally on the phone where I explained I had written a letter and they said 'thanks thats fine etc'
    I never wrote to the LEA or received anything from them - I just did as it said on the University website which is to write a letter to my course department and admin section of the Uni.
  • Just to be fair - I wouldnt have known to chase confirmation at 18, and Im not sure how many older people do now.

    OP - worst case scenario, you pay back the fees, you wait six years for credit file to clear, then you are okay. Hope this works out for you.

    Just dont forget to chase the solicitors now. You are paying them. You pay them for every phone call, so make appt to see them, sit there with a list and ask. Take notes. If you dont understand, ask. They are supposed to do what is best for you, they have rules about it. And you can still ring the court and see what they say. Dont expect much, esp if London court, but worth a punt.

    Thanks Tamsin - the court I receive correspondence from is Liverpool County Court, not sure why as the Uni is in Outer London..!

    Theoretically you can issue in any court in England and Wales, so you could live in Penzance and issue in Carlisle. Liverpool may be convenient for their solicitors.

    If you have applied to set aside then the hearing should be in a court local to you. If not, ask the court why not.

    Did you apply for grants/loans for the course from your LEA? Did they paid? If you enrolled and applied for finance I presume you received the first payment? If you didn't receive any payments subsequent to that then they must have been told you'd withdrawn. Which means you may be able to prove that you officially withdrew from the course - how would the LEA know if the university hadn't told them.
    If you log into your student finance account there should be a copy of all the correspondance your LEA sent you, may be worth having a look to see if you have a letter stating withdrawal from your course. I know you said you didn't receive a letter from them but 2007 was awhile ago and I know what I'm like with paperwork :p

  • If you have heaps of other debt, then getting this ccj set aside is just delaying the day that one will be entered against you. I would suggest that you stop burying your head in the sand and hoping all these problems will go away, but actually address them.

    First step would be to get a statement of affairs drawn up and post it on the debtfree wannabee section, so that you can get some good advice on how to get yourself out of the mess you have created yourself.
