full and final advice please
Options
Thanks to your advice and the kind lady at the finance company, they have accepted my offer of a full and final payment on some dodgy car finance my dd had defaulted on.
This was agreed over the phone, and the company has sent me an email confirming all this to take to my bank so they will pay over the money (see below). She said there was no need to put it in writing as the phone conversation and email had bypassed that bit .. is this right? should I email her a formal reply to confirm before paying the money?
Help! don't want to !!!! it up right at the last minute
Further in this matter and subsequent to our telephone conversation of today I can confirm that I have spoken with our clients in respect of your offer of £3,000 in full and final settlement. They have confirmed that they will accept this offer.
Please therefore arrange payment into our bank:-
******* Bank
Account No. ******
Sort Code. ******
Reference: ********
It is extremely important that when you make payment you quote your reference as without it we are unable to trace payments made.
Upon receipt of funds we shall provide you with a letter confirming settlement.
Should you have any queries then please do not hesitate to contact us.

If you are worried, try doing a google search on teh bank account number - that should reassure you whether it is a genuine account or this ladys swiss bank account!
You could try calling their finance department and ask them to confirm account details independently for you.
Good luck
R.Smile, it makes people wonder what you have been up to.

lol thanks for the reply
i wasnt so much worried that the lady was going to run away with my payment, but wondered if it was OKfor it be agreed in an email like this rather than written letter in the post? I've drafted an email to reply using the draft F&F letters that are available and think it would be OK, but don't want to pay over this money, which is all I could scrape together and then have them come back after me later.
In reply to your email which was received this morning.
Thank for accepting my offer of £3,000 in full and final settlement. I would like to confirm that this payment is a full and final settlement of the account. This offer has been made on the clear understanding that, neither you or any associate company will take any other action to enforce or pursue this debt in any way whatsoever and that I will be released from any liability.
I also request that, you will make any entry on a credit reference agency file relating to the above account as "satisfied" in full.
Payment can be made within 5 days of receiving your agreement of this offer and method of payment.
I look forward to receiving your reply.
Yours faithfully0 -
I'd would try to get that further confirmation. Whilst the fact that it does say F&F means it would probably be okay, I would push for the not being chased further bit. I'd also be tempted to make that sentance say neither you or any associate company or any third party will....

I'm not certain - but I would have thought that email would be okay (unless anyone else suggests differently)A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0

I can confirm that no proceedings have been issued as yet therefore no CCJ has been issued.
I can however confirm that upon receipt of your payment we shall close our file of papers.
