Private agreement

hello all, my daughter was 18 in april finished college last october and is now claiming I.S i have a son who is 16 and going to college in sept. me and x have a private agreement and have done for the 11 yrs we split and all has gone well 1 little slip up when bank account changed but i am paying the arrears off 25 extra a month which was agreed by x i paid 150 per month which is what was asked for from x which i didn't dispute.however csa calculator has 30per week for 1 child can i reduce the ammount i pay or would i be better going through csa if x gets on their high horse also if it went through csa and they said i wasn't paying enough over the last 11 years would they add the last 11 years up and take this off me? mant thanx

Have you not discussed this with your ex? Obviously there is only one child to support now, so in theory it should mean a reduction. However, if you underpaid over the past 11 years then it would even it out if you left it. If you haven't underpaid, then if your figures are correct there isn't much your ex could do about any reduction.

So you got away with less than CSA would've required for 11 years because your x was happy with that arrangement, but now you see that you can save yourself a few pounds per month, you would call any disagreement to this as 'x getting on her high horse'.
If you do intend on doing that - do be prepared for her not to be happy about it - but.....you could point out too that now your son is at college, he will be eligible for EMA funding - up to £30 per week depending on your x's family income - but then, your daughter was likely eligible for that and receiving it while she was at college too - so might not be much of a carrot - sorry!
You do need to sit and discuss it with your ex - and just bring up the fact that you are still paying what you paid for two children, and figure out what the CSA rate would be for one, and see if you can get an agreement on that!0
