ccj sent to wrong address

I have a problem that has only just come to light. I had a Dorothy Perkins Store Card which was paid regularly and at the end of 2005 had a debt of approximately £50.00. At the time I moved address and notified GE Capital of my new address. I didn't think any more about my Store Card as I received no mail from them at all and didn't think anymore about my debt. I assumed that I had paid it off as I received no correspondence from them and to be honest I was so busy I didn't give it a second thought. Recently however I went to my bank to ask for a bank loan to set up a business only to be told that I had a CCJ. I immediately contacted GE Capital who advised me that they had sent correspondence to me and had received no response from me and the debt was subsequently dealt with by the County Court and the debt passed on to a Debt Collection Agency. The debt has now reached over £500.00. I then discovered that GE Capital had taken the wrong address and had been writing to me at a house address of no.8 instead of no.3. MY bank manager advised me that I should notify GE Capital that I was totally unaware of the debt and that I should make a formal complaint. I have done both these things but GE Capital say that I still have to pay the £500+ and they will not clear the CCJ until I do so. Can anyone help me with this matter, I don't know whether GE Capital are blagging me or what!! Help!!

    I believe that you may go back to the court and apply for the judgement to be removed, under the circumstances you describe.
    Try finding out at which County Court the judgement was obtained and call their office. If not - CAB.

    It seems to me that GE Capital are the ones at fault not yourself. Ask them to clear the excess and inform all credit agencies immediately that the debt is clear. My self personally I'd try asking they for go the £50 too but pay it if they refuse to comply tell them you will be making a complaint through the Financial Ombudsman Service. I can't see you losing your complaint and FOS are liable to order GE Capital to pay you compensation, usually £100.
  • GE Capital are awful. They did exactly the same thing to me, I wrote to them with a new address, received a phonecall a few months after and they had me old address... that was the end of that account + one DCA later. Fools
