complaining about equitable charge off the deeds

Hi, wasn't sure where to put this - but I had a equitable charge placed on my property in 2006 - it was against me not paying back a loan I had with the nationwide, at the time I was protesting against them concerning my endowment mortgage. Anyway I paid this loan off a couple of months after (2006) I am now 4 years on, ready to move house, van loaded. Solicitor gets word that nationwide haven't removed the equitable charge off the deeds.
I ring nationwide they say it’s been that long they can't find the records and need time to sort this where do I stand. I am sick to death with their attitude there must be somebody to complain to, they are law onto themselves. so it’s no good complaining to the nationwide, in the past I complained to either the FSA or FSO I can’t remember off hand because it was in 2006 but they sided with them.

    Yes it is as that is whom you have to complain to.
    in the past I complained to either the FSA

    Unlikely to be the FSA as they dont handle consumer complaints.
    FSO I can’t remember off hand because it was in 2006 but they sided with them.

    The FOS are more likely as you can go to them after you have exhausted the Nationwide's complaint process.

    However, I very much doubt your complaint in 2006 was anything to do with your current issues. i.e. if they only put the charge in place in 2006 then they would have a record.

    So, this is a new issue on a related subject. So, if Nationwide arent going to help you then you have to complain to them.

    Your solicitor should lean on Nationwide to get confirmation that they no longer have an interest in the property.

    The nationwide are a law onto themselves they cannot be be bothered - I have been very patient and carefull what I say not to upset them, this equitable charge is related to my complaint in 2006 it may not be in posters eyes here but to mine, it is. This charge should have been removed in 2006 when I paid up, I shouldnt have to be telling people in the know how to do their jobs.

    I needed to move in yesterday - my solictor has been onto them, they are stalling saying they have no records I can't say this any clearer - I was on the phone yesterday to the nationwide - a girl from their office said all she could do was Fax my solictor a letter saying they will remove the charge but she didn't - this atleast would have allowed to to move my gear in -
    My head was in a spin last night when I posted here - though I take onboard today that it is the FOS I need to contact. And now its the weekend and they are all shut.........!

    Its related but your complaint in 20006 sounds like it was about the adding of the charge, to which the FOS agreed with Nationwide. Your complaint now is that there shouldnt be a charge as it was settled and that Nationwide cant find any info. That is two different things.
    though I take onboard today that it is the FOS I need to contact.

    The FOS will only review a complaint once the Nationwide have first and given the outcome.

    My complaint was about my endowment policy being mis-sold,and not going to pay off my mortgage - when I took my mortgage out in 1998 I didn't want a Endowment Mortgage I was young and forced into it, given wrong advice by nationwide staff. I stupidly stopped paying a £9,000 loan until they settled my dispute - a woman rang me and said she could make my life hell, at the time I didn't care - and didn't realise the nationwide would hold this against me for six years. The FSO were unhelpful and sided with the NW. We live and learn I’ve obviously been tortured by them. In 2006 I asked for meetings with their staff at Northampton to sort this out but they won’t budge.

    Hi Mark you need to send the RIGHT kind of letter to Nationwide proving you have repaid this charge on your house!
    Your solictor should be your first port of call and having letters from Nationwide stating that this money has been repaid would help greatly.
    Moving is very stressful but back onto the solictor first thing monday morning and keep all paperwork relating to the house and mortgage safe

    The FOS are not there to support you or the lender. You made a bad choice in stopping the payments and the Nationwide did nothing wrong. The FOS work on the basis of law and regulations and there was no way they could side with you.

    This is of course your opinion I don't need you telling me I made a bad choice by stopping payments, it wouldn't have happened if the NW had had the guts to face me.

    I need to count to 10 - I'm so annoyed I have had to rent a unit to store my furniture - hire a van to transport all or some of my belongings. Obviously I need to have this money reimbursed as it appears I am going to have to put this move on hold – the solicitor may need to answer questions here, they not working for me for nothing, 30 days time they will want a payment from me, do I pay up? – do I ask them to sort this problem is it going to cost me more money I really don’t know.

    My solicitor has copies of letters and a letter of satisfaction from the courts to say this money has been paid back. I’m at a stalemate waiting around wasting my time off work. I put holidays in for Friday and Monday. I really don’t know when I can get time off again it could be 2 weeks before I’m off again.
