ACEY and Clearingout what you need to do is ask them to forward it to the criminal compliance team. They have the power to force him into a face to face interview under caution where they can look at all of his books. Under CS2 you can ask for all of his dividends to be taken into account as part of his assessment, but it is not automatic.
If you can give them any sort of evidence (land registry documents are free, electoral role etc) then it can also be passed onto criminal compliance who have the ability to backdate the assessment to whenever they like. Its worth keeping going because in the end it will happen.
Woody, its not about being bitter and twisted, but about getting the money that will make your chidrens life easier. My ex pays £5 a week, according to the CSA in January, he is not working. I provided them with evidence that he most certainly is, and they are now in the process of enforcement, I have offered to make a private agreement, have asked him to contribute to the cost of the kids shoes etc etc. He has refused all offers of comprimise so I have no option but to use the CSA and he will gather arrears, which will probably be eventually force a liability order on his house. Its not because he cannot afford to pay, its because he will not, and before you ask me how I know that, he owns 2 houses, a business property and has been boasting about his latest new toy that has just cost him in excess of £20k, but he will only give each child £2.50 a week.

Well said! My ex was exactly the same - still not paid the last £950 he owes; he was due in court on Friday. No news but I'm sure it was adjourned AGAIN (which will have been the third time this year already).0

I agree with some of the things you say, but none of you try to make it any better for the dad seeing the child.
the difficulty with these kinds of comments, woody, is that the generalise way too much and don't even begin to understand the individual, unique situation that everyone of us is in. My ex sees his children on his terms, each week, every week. He has taken my home and ruined my credit rating whilst he and his girlfriend had 4 foreign holidays last year and drive his and hers matching new cars. All paid for by the business I helped set up and indeed, which wouldn't have been the success it is today if I hadn't written the first 50 tender documents (or so). It is not too much to expect that after years and years of support and fidelity on my part, he supports his children before taking holidays. I don't begrude him his hard work, not at all, but he can more than afford to keep a roof over our heads whilst I re-train and he could more than have afforded to pay his bills so he didn't run up debts and CCJs. He chooses not to.
On the other hand, my world was ripped apart, I was left pregnant, and forced onto benefits as the ex took away my very small part-time salary from the so-called family business. He refused references and legal documents such as P60s and P45s making it very hard for me to move forwards (pregnancy aside). And for good measure, he took me to court for shared- residency of the children because he thought that would stop me moving away (it hasn't, just cost us both an enormous legal bill) when all he had to do was be decent.
Now, if I were a bitter old woman, don't you think I would have locked my doors, run 300 miles in the opposite direction, refused all mediation etc. etc. and never have allowed him to see the children? Our children, I am proud to say, see both their parents, have both parents pick them up from school, have both parents attend their school plays. This old woman puts aside her fear, pain and sheer incomprehension that a man she had previously loved could behave so dreadfully towards her. She pays for football and swimming and puts food on the table without saying a word whilst wearing the same pair of shoes every day for the last 12 months. And when teh children are in bed, she cries, very hard, about the sheer injustice of it all and wonders what on earth she could have done to deserve such treatment. No doubt, woody, you will say, just like my ex-husband, that I must have been a dreadful wife and that I deserve everything I get. And that, I'm sad to say, is why so many of us are unable to put aside our differences for the sake of our children. And exactly why it is necessary that an organisation like the CSA, however inept, has to exist.0 -

yes - got nowhere as I had no evidence. However, since then I have acquired his business bank statements as part of the divorce process so I need to try again. I am not sure that making payments to Thomas Cook and First Choice constitutes business expenditure now, does it?!!!0
