Debt referred back to egg from dca

Hi,

I have been purusing dca for copy agreements of egg loan, but no response was heard (apart from dca stillrequesting payment).

I ignored the requests and recently received a letter from dca saying that they had closed the account and it had been returned to egg to take over the collections.

Can anyone tell me what happens next once egg contact me.Should I respond to egg beginning the process again of requesting cca's or ...? Not really sure where to go from here.

Many thanks.

If egg respond then you could ask them for a copy of the CCA. I believe that all the egg documents are online applications though and i'm not too familiar with the requirements of these as there will definately be no signature.

If they pass the debt on to another DCA, then you could do the CCA request to them and hopefully get the same result. Do you have a note of the last time you made a payment towards the debt?

  • Hi,

this debt is a few years old so there was definitely a signature.

Well, as the account is in disoute i stopped payment a few months back, and all ive had from the dca is half hearted atempts to get me to pay, and now the acount is closed and sent back to egg.

So im not sure whether i need to start the whole cca process again really?

If u sent a cca request and they failed to action it, and you put the account in dispute the letter to send to egg if they decided to ask for payment is - http://forums.moneysavingexpert.com/showpost.html?p=30356257&postcount=19

Although this may need editing as it is a OC -> DCA letter

In which case this maybe better http://forums.moneysavingexpert.com/showpost.html?p=30356471&postcount=29

Sorry - i thought that all egg accounts were opened online.

You can definately request a copy of the CCA from Egg. If you make a CCA request to an organisiation, they are not supposed to pass or sell it on to a 3rd party, but they can pass it back to the original creditor. If you make the request to the OC, then they need to deal with it at themselves.

If its anything like my Capital one agreement from 2005, well the sheet of paper they sent anyway, I applied online and they sent it out for me to sign, return and then the account was opened. :)
