Goldfish debt moved to Barclaycard but...

Can any one help me out here?

I was investigating my DMP debts and noticed that I have a debt moved from a Goldfish card, that I had when the DMP started in 2008, moved over to Barclaycard.
I never had the Barclaycard before I got the DMP, so Barclays, who must have owned (?) Goldfish have taken over the debt. Thing is, I think this is wrong. I never signed anything (agreement etc.) or actually have a Barclaycard in my possession (obviously they won't give me one because I am on a DMP) but I am sure that you have to sign something to agree to having a credit card debt, as surely this is for purchases and not old debts from somewhere else?? or can THEY move the debt from card to card?
I think this is also wrong because of the extortionate level of interest on this Barclaycard... agan, really unethical, any advice anyone? I'd be very grateful :o

    Barclaycard bought Goldfish.

    Goldfish doesn't exist any more.

Therefore your debt on your Goldfish account number is now a debt on a Barclaycard account number.

It all depends on the terms of your agreement, but in most circumstances they can't change the rates they charge that, so if goldish was at 19% BC can only charge 19% if it was transferable otherwise they cant charge anything, it is just a debt.

I do believe BC brought alot of goldfish cards but didnt get the CCAs, i would therefore send BC a CCA request to check enforceability, on a DMP it might not help but could potentially shed some light on if they have charged anything were they allowed to do it, and also would they take a low settlement offer - http://forums.moneysavingexpert.com/showthread.html?t=2305463

I used to work for Goldfish (was paid off as Barclays shut our centre down). You would have received notice to tell you Barclays were the new owner and also when they were integrating Goldfish over to a Barclaycard.

Re the CCAs DarkConvict probably has a good point. Goldfish were previously owned by (deep breath)

Centrica & HFC with LLoyds having a small ownership too
    Lloyds
    Morgan Stanley
    Barclays

I would definitely try the CCA route.

No problems, I worked there for 6 years and I think the longest ownership of Goldfish in my time was 18 months to 2 years so you may well have some luck with the CCA route.

    Good Luck :)
  • Hi,

Have just read this thread with interest as I had a Goldfish card and remember it turning into a Barclaycard. I didn't have to sign anything, just told it was happening and a Barclaycard turned up in the post.

Anyway, whats made my ears !!!!! up is the CCA bit. Are you guys suggesting that because BC tookover Goldfish there may be a greater chance of having the debt made unenforceable as BC are likely NOT to have all the Goldfish paperwork i.e CCA's?

If so that would be good as I also have a very old Egg card, and with BC they are my biggest creditors. Could be worth a go?

The CAG forums can probably tell you more the odds of if they have the CCA, but im sure i can remember reading many Goldish/Mortan Stanley cards never had the CCAs sent to the new owners.
Remember, unenforceablility does not wipe out the debt.

There were many set up problems when Morgan Stanley took over GF with card issues etc. If you were a long standing Goldfish customer then there could be a chance there is CCA paperwork missing, but it's not guaranteed.
  • Thanks for that,

Darkconvict - what does CAG stand for, so I go to the right forum.

    Thx
