I have just been passed to Wescott DCA by MBNA do i have to negotiate my DMP with them even though MBNA accepted it and froze interest and charges or will it all go pear shaped again and the debt start growing due to wescott adding to it0 -
Hi,
I have a real big problem with joint debt between myself and ex partner. She left me 12 months ago and we still have a mortgage, loan and overdraft together.
She is not paying any money towards the overdraft that needs clearing, has missed 2 payments on the loan and is being totally unreasonable about the house.
Can you suggest ways in which any of these can be split so they are totally separate. Surely it cant go on like this??
Any ideas would be a great help!!!

Hi,
I want to go through a DMP with CCCS. I have the forms ready to sign and return.
Thing is, my car has just completely gone. It's going to cost a fortune to fix it, more than it's worth! So, I need a new (2nd hand) car and one that is reliable as I need it for work. I have just enough credit on one card card to buy a car (2k).
I'm wandering if buying a car would go against me when CCCS contacted the creditor about my DMP?
I also need to update CCCS on my situation. I'm wondering if you would advise not to use any more credit?
If this is going to lessen any chances of a successful DMP then I'm stuffed because I need a car.

Apex Credit Solutions & Lloyds TSBHi I'm looking for some advice, its a bit of a long story but it all started with bank charge setc. etc. I argued with the bank over years worth of charges even raised a small claims case, which got stayed and I guess is now moot, during this time I lost my job and my overdraft charges mounted against my £500 overdraft the debt now totals £800 odd.
I argued withe Ombudsman that Lloyd s had failed in their duty as they never tried to assess me or offered any kind of a payment plan, unlike Barclay's which it pains me to say behaved exemplary, Lloyds never did anyhting but send threatening letters. Anyway the Ombudsman ruled the debt stands and that was months ago, January time since then nothing. Two weeks ago I got a letter from Apex saying their acting on behalf of Lloyds (Yeah right) and would I like to sort out payment so I called them and offered the lady £30 quid a month, which is about all I can spare as a small family and me the sole earner. They then demanded financial data so they could assess what I could afford and I said I had told them what I could afford and that they as a third party had no right to my data and I would have to take advice, I then said will you take my £30 and she said not without figures and there it was left.
I should have written but I have been a busy at work and today I have a letter saying:
"Apex Credit Management are dissapointed that despite our efforts to contact you regarding your debt with Lloyds TSB Bank plc. you have failed to reach any agreement with us.
We now believe that you are simply avoiding paying your debt and must therefore act in the best interests of our client.
We utilise external data sources to profile our accounts carefully and believe that you have the ability to make payments on this debt. Consequently your account will be passed to our internal litigation team in order to consider the best course of action for recovery of the debt outstanding. This may include legal action to obtain a county court judgment which may then seek to enforce by wat of a charging order or attachment to earnings application.
Please contact us yadah yadah yadah......."
No time frame given.
I just don't know what to do, I will happily pay them £30 a month if it is easiest but it would leave a bad taste, or can I tie them up in paperwork like CCA requests, challenge the validity of the debt. I never signed anything regarding the overdrafts and the manager who when I lost my job arranged the first £250 and subsequent increase to £500 overdraft then just vanished quite abruptly and the bank say they didn't know I lost my job.
Please, please help any advice would be appreciated.0 -

Having gone through the budget and the list of creditors there are a couple of changes I need to make to the amounts I owe and there is another account to add which has been missed while I was on the phone. What do I need to do about it and will it delay setting up the DMP?

I have credit card debts totalling about £2500. I am looking to change cards to a 0% balance transfer to cut the cost of my debts. I managed to open one with barclays but they only gave me an £800 limit so I couldn't transfer all my balance but at least it helped as it is 0% for over a year. I am in the position now where I have £1700 on one card which I am getting charged about £25 a month interest which is a lot. I wouldnt say i'm in financial difficulty as I work full time so i'm not struggling to keep up with repayments, I would just like to repay it as quickly as possible. I have since applied for another credit card with a 0% transfer but they didn't accept me. I'm not too sure why as I have never missed a payment, but it could be something to do with the fact that I have borrowed the maximum amount available to me with regards to my current financial situation? I have contacted my current card company who say they cannot do anything for me unless I am in financial hardship but that would affect my credit rating and I do not consider myself to be in such hardship. I do have savings but not enough to cover my £1700 on my card thats charging me interest. Any help would be greatly appreciated. Thanks

If you are only making the minimum payments on a high interest credit card, it can take a very long time to clear the balance. Transferring the balance to a 0% card makes good sense, but sometimes, it is not possible to do this, which can be very frustrating! At least you have managed to transfer some of the debt.
Applying for several different 0% offers may also affect your ability to obtain credit.

Hi,
I filled in the online forms for a DMP yesterday and have now received the next email which I need to fill in direct debits etc to CCCS, however I also need to include pay slips and statements from my creditors - it say's to refer to the booklet, however this booklet was online and now I cannot access it through my online ID. Can I find a copy of this booklet online or can anyone tell me what is accepted as statements? Eg is an email from pay day loan companies saying I owe xxx amount enough? And also how do you obtain statements for an overdraft or can I just print a copy of my online statement showing my HSBC overdraft and HSBC loan?

The reason we need statements of all your debts is because we need the account numbers, the addresses of the creditors, and the up to date balances. If any have been passed to collection agencies, we need their details.
So, if your online statements show all this information, then they should be ok.

You need to start making the payments to them. They may need a copy of your income and expenditure. Stick the payments you can realistically afford and do not be pressured into paying money you do not have

Unfortunately if the debts are joint, then you are both joint and severally liable, which means that the creditors can pursue both of you to recover the whole debt.

If your car is essential for work, then it could be classed as a priority.
I do not have access to your full financial circumstances, but could you consider putting any spare money aside to save up for the car and make token payments to your creditors until you have enough? Or would this take too long?
If you have no other option than to buy a car on credit, then I would recommend that you call to speak to our client support team who will look at updating your budget and advise you further. It is possible that you may have to look at other options until your car is sorted out.
