Hi ive just got a quick question hopefully someone might be able to answer for me please asking on behalf of a friend, my partner got an debt collecting letter from a old debt he payed years ago 7, but never kept prove, anyway a contacted cab and they said after 5 yrs weather or not its been payed they have no right to pursue you for the debt is this correct, i argued this on the phone and the debt collecting company said sorry and said he wont hear off them again, which was great but i was telling my friend who owes concil tax money from over 5 yrs ago when he suffered ill health, and he asked if he would still have to pay it, i dont know would anyone be able to give me some advice pls, hes not trying to dodge paying what he should has worked hard all his life ect, thankyou0

I would like some help please.
I have a number of debts which i wont go into at this minute.
Amongst my debts are two CCJ'S.
At the moment i have been off work with medical problems for nearly six months.
All i am being paid is SSP SO money is very tight.
Aktiv Kapital has taken over one of the ccj's[it is for around £950].
They have requested i pay them £32 PER MONTH as from now.
I am trying to pay all of my creditors a token payment at this time[£1 per month],but as this is in respect of a ccj do i have to pay this much to AK?
What would be the consequences if i refused to pay that amount?
I live in rented accommodation and am currently receiving HB and CT benefits.
Your help would be appreciated.

Hi, I was taken to court two years ago by Mortimer Clark Solicitors on behalf of Marlin for an old car loan. I disputed the amount and the case was transferred to my local County Court. Mortimer Clark attempted to persuade me to sign a tomlin agreement but I refused. They never filed the allocation questionnaire for the court and the case was closed. Recently Marlin have started telephoning me asking to discuss the debt. Is it legal for them to do so bearing in mind that this has already unsuccessfully been brought to court?

So did the debt ever go to your local county court? A Tomlin Order is usually issued to avoid court action where it could affect your employment but this doesn’t seem to be the case in your circumstances.
They can chase you for the debt if it’s still outstanding – you didn’t mention whether you disputed the entire amount or just part of it.

Hi sezsez and thanks for your question.
The Limitations Act in England applies to debts that were taken out over 6 years ago (it’s slightly different if you live in Scotland for council tax though).
You’re right that the debt could be unenforceable if it had been over 6 years since he paid anything but they can still chase him if he’s liable to pay it.

Hi diplodocus22 and thanks for your post.
It’s best that you stick to the amount that the CCJ was originally was set for so they don’t take any further enforcement action – AK can’t increase the amount themselves though as they’d need to take it to court first. If they haven’t done this keep paying the same amount.
If your circumstances have changed since the CCJ was set you can apply to the courts to very the CCJ to an amount that you can afford. You’d need to fill out an N245 form which you can find online: http://www.nationaldebtline.co.uk/england_wales/pdf/n245_form.pdf.

I am looking to start pay £800pm for 2-3 years to pay it of but the intrest is killing me! is there any anyway I could get them to put me on a 0% deal??

Hi Davie and welcome to the forum.
It’s unlikely that they will agree to reduce the interest to 0% on your existing debts but you could ask them to reduce it. There’s no guarantee that they’ll agree to this so you could look at transferring your credit card balances to a 0% interest deal. Hi, this is just a quickie, hopefully someone will be able to help?
Im 9 months into my DMP, after lots of help from everyone here and all going great. However, I put my car through MOT in Feb and had an advisory on the brakes, couldnt afford it then and although I have been trying to set aside for it things just keep cropping up.
Its now DESPERATE and will cost about £400 to sort out.
CCCS emailed me a while ago for a budget check and I missed a call but with working 5 days and 2 young children i just havent had time to call them back yet.
Now I need thier help and still dont really have time to dig everything out and go through it again. Do you think they will be able to let me miss next months payment so I can pay for it when I get paid this week? Or will I need to go through the bugdet allowing a bit more every month and take the car off the road (when I need it for work) until I have saved enough?
No trouble calling them but just want to know what im likely to be faced with, really need them to help me quickly as I'll be stuck without the car!!
Thanks for your help, still a relative newbie that just wants all of this debt to be repaid so i can get on with life!!!0 -

If the repairs are urgent and you need the car for work it sounds like it’s important that you get it sorted as soon as possible. It shouldn’t be a problem for you to miss or reduce your payments as long as you give as a call to let us know.

I have an enormous amount of personal debt - almost £200K. A great deal of this is on credit cards. I have made a concerted effort to pay these down and have halved the amount I owe to them over the past two years. However, I am self-employed and have no income over the summer. I am trying to eek out the money I earned in the Spring but it isn't going to last long unless I can reduce the payments I have to make against my debts. I have heard that credit card providers will freeze your interest and let you pay extremely low amounts each month in situations like these. Words of wisdom and experience would be appreciated.0
