  • HELP!!Hi I also have a question. Hopefully someone can help me. I am in debt up to my eyes also. I took a loan from ulster bank for £16k in May 2008 to clear both mine and my partner debt. My partner turned very abusive around July 2008 just after all the cheques cleared to pay her debt. I couldnt take it anymore so I walked away from the marriage and havent looked back since. I paid the repayments on my own for 18 months @ £340pm without any help from her and I entered into an IVA in Sept 2009. The IVA failed on my part. So now I dont know what to do. I'm being tortured by the bank. I've done an online expenditure on cccs and my outgoings are more than what I have coming in. I'm a civil servant. I earn £1062 per month but I am still trying to get my life back since 2008. I am also paying for a costly divorce as my ex has left me to pay for that too. In total I owe £18.5k. The loan I took from Ulsterbank is solely in my name but I could easily prove that at least £8k went towards her debt as I wrote the cheques to her creditors. I dont have any problem paying £40-£50 a month for 20 years if thats what it takes. I just really want to know what my options are. Can anyone help me? Is bankruptcy for me?

Hi CCCS Counsellor I hope you are ok?

I have been on a DMP with CCCS for around 4-5 months and it was going great and my stress levels dropped and I felt control for the 1st time in ages. I stupidly though one month took a payday loan out with Wonga because i overspent for a few months and im in sales and didn't earn any commission for ages. I really cant afford to pay this payday loan off in full and im worried off getting into a viscous circle and also will CCCS not want to help me any more. Please help it will be most appreciated.

    Thanks

Hi ILOVECARP and thanks for your post.

I’d recommend that you contact us as soon as possible so that we can get this debt included in your arrangement.

We can also look at your budget to see if we can prevent this happening again.

It’s always better to call us when you are struggling rather than take on further credit, but please get in touch and we’ll see if we can find a solution.

    I hope this helps.

    Kind regards,

    Mat

  • I took out a loan in 2004 and then defaulted on the account in nov 2005, it has been passed from one account holder to another and I did make a payment arrangement which I stuck to in 2008.
The account was sold on during this agreement as I paid late, and payments went missing to a sum of £750 in 2008/2009.

Nobody has been able to locate this amount and I have contact the solicitors who have been dealing with it and they keep saying they are looking into it but that's been for about a year! Last time I heard from them, when I contacted them to ask what was happening, was Jan 2011 and they again said same, someone is looking into it.

Although the £750 doesn't clear the whole balance, will this debt get written off?

    Someone help please :)

    Thanks in advance.
  • Hi
I would like to get advice from you, what i should do about the situation im in.
2 yearys ago i moved from UK i lived there for 4,5 years, i had my bank account in HSBC Bank. When i moved abroad i didn't close my account because i still have money in there to apy my mobile phone bills and i needed to keeep my account open to get deposit back from the estate agent for my house. After 6 months somehow i had £9.00 overdraft and the bank charged me £70 for it then they were charging more and more and because of this charges they made bigger overdraft. i called to HSBC to explain this, and pay this off(i didn't want to have problems) and i asked for my international account numbers to make transfer from my spanish account and then i wanted to close my account there. she said that to get this number i have to go to the bank myself the same to close my account, which was impossible because i was 7 months pregnant... She !!!!ed me off i wanted to pay money i owed and she didn't want to help me. I left it like it was then. Yesterday, for the correspondence address in UK came letter from Debt collectors, they passed my case to the Wescot credit services.I can't contact this company form abroad they dont have special number. Plaese give me advice what i should do now? i m not going back to UK but also i dont want to have any problems with that. i don't have any income, or maternity i m at home with my baby, so it will be difficult to pay it(i m not sure how much they asking me to pay)please help me...
    Regards Maggie

Hi I need some clarification please...

I have just under £33K of unsecured debts ( CC's & Loan) and I am looking at setting up a DMP, I am unclear how my husbands income and debts relate to mine if at all. The house and mortgage is in his name, and also the car so does this mean that they are not taken into consideration when looking at assets available (they wouldnt add to much anyway - finance on car more than worth and equity is about 3k on house)

and when listing the items on the financial statement I have put down that the rent we pay (we rented out our own property to move closer to work/family for financial reasons) I pay the full amount basically my question is do i split the household bills 50/50 for my personal expenditure sheet or do i put the full amount of all that are in my name and leave out those in my husbands name? I really am unclear in this....

    Thanks for your patience..

I have some questions if that is ok?

My first DMP payment to CCCS is due on 1st August. This month, I sent all my CC's and bank (overdraft) a token payment of £5 with a letter explaining that CCCS would be taking over and asking if they would consider stopping interest and reducing payments.

I've just had a credit card statement from Halifax. The £5 postal order I sent hasn't been credited to my account (sent recorded signed for well before the due date). I know the address is ok as another £5 I sent to the same bank/address to pay my overdraft has been credited, they have also added a late payment fee, defaulted the account and raised my interest from 4.94% to 23.53%

Re: the non appearance of my £5 payment - should I write to them and follow this up?

Re: late payment fee - do you think this because they haven't received my £5 or is it because I haven't paid the minimum?

Re: interest hike - should I write to them and ask them if they will lower it? Or should I just leave it to CCCS to negotiate interest rates?

I really would prefer to not ring them but I will if you think it would help. I was paying low interest rates on most of my cards, it was the miminum payments I was struggling with so now I'm really worried that the others will follow suit and put their rates up too.

Sorry to ask so many questions.

    :o Sorry another question

My halifax credit card statement says that they can take money from other accounts I hold with them to pay off my debts. I opened a save4it childrens account for my daughter when she was born and she has been putting grandparents birthday/christmas money in it. She has about £700 in it. Can they take money from this?

Just editing to say ... no need to answer this now. I've just got back from the bank - I was able to withdraw it all in cash and have now closed the account.

Hi Jenmcd84 and welcome to the forum.

It’s difficult to know whether they will write this debt off or not, but it’s likely that once they’ve located the paperwork they will start to chase you for it.

I’d recommend that you look at your credit file to confirm who the debt is registered with. Once you know this for certain you can write to them and ask for details on how to pay. Make sure you send it recorded delivery and keep a copy of everything you send.

Hopefully this will resolve the problem, but let us know if you need further advice.

    Kind regards,
    Pavan
