Struggling with debt? Ask a debt advisor a question

ticklemonkey wrote: »Is there such a thing as being one month ahead with CCJ payments?
If im paying off a CCJ and the first month it was due i made two payments, one before the due date and one shortly after both for the full amounts, does this make me one month ahead of the payments?
Reason im asking is that im paying off through Payplan and this is what they told me. They cant guarantee to get the payment to the creditor by the due date so i made an extra payment in the first month to stay "one month ahead" of the payments so that if the payment they make each month is late it wil be ok as im one month ahead??
Is this right does anyone know?
thanks

Hi
I'm upto my limitwith my credit card and have been paying my minimum payment. Due to this Natwest have been added charges and I can't keep on top of the payments they are asking for as I have bills to pay also. I had a call this morning from Natweswt stating that they want to put me on a payment planbut still requesting more money than I can afford to pay. I asked to have set up direct debits payments and I can then pay any additional payments on top.
I have never missed a payment with them, but what they are requesting for payment plans I don't seem to trust them and also the payment amounts that they have requested and charges I just can't afford to paym the full amounts. This leaves me only being able to pay the £50 min amount. I owe 2 thousand pounds and not sure how to reduce the payments.
Hope you can advise please!:(0 -

Yes, it’s better to transfer everything to your new account and pay off the overdraft at a rate that you can afford.
With regards to taking you to court, your creditors can do this at any stage after you have defaulted. You can read more on our website about the standard
It sounds as though you’re well on your way to repaying your debts, but just let us know if you need any further guidance.
Kind regards,
Pavan
Hi Pavan, Thanks for all your help. Got my overdraft charges reduced for 6 months. Just waiting to hear back from the 3 creditors and if they agree to my proposition. Wish I had have done this a year ago, debt would have been less. But better late than never!
Thanks again.0 -
This is my soa. My mortgage is currently on svr 3.5% With Halifax (int only) (no rep vehicle in place) and my cc are on 0% usually just do a bal transfer if can't pay off in 0% period... personal loan is 218 os bal 7500 is paid off in 36mths and won't have to pay childcare as of sept next year.. (but what we have or don't have that causes me concern)!!
(Thankfully my husband is a technician so don't need to pay for maintenance of the cars..
The thing that worries me the most is that were not paying any capital off our mortgage due to having no money left over at the end of the month.. (int rates are only gonna go up).. so need to get my finances in order or we will end up loosing our house...
At the moment I am working all the overtime I possibly can and selling unwanted things on ebay..
Any advice would be appreciated..
Thankyou.
Hi HBRAD123 and thanks for your question.
Generally we give advice to people that are struggling to repay their debts but it looks like you are currently managing ok.
You’re already doing as much as you can by working overtime and selling things on ebay to maximise your income and the only other suggestion would be to look at cutting back on your outgoings. Having said that, I’ve had a look through your income and expenditure and it looks as though your expenditure is all very reasonable.
If your mortgage does go up, you could look at offering your creditors reduced payments. However, we could only look at this and your other options once we know that your mortgage payments have gone up and how much by.
If you’d like to get in touch to discuss your situation in more detail, you can call our free helpline on 0800 138 1111. Lines are open Monday to Friday 08:00-20:00.

Hi all, I'm a newby on here so please be gentle!:)
We have been on a DMP with CCCS for 16 months. Our main creditor is LLoyds. We have a loan, two credit cards and two overdrafts with them. We have sent loads of letters to them asking them to freeze the interest but they have refused everytime. Our loan is the biggest debt with them. We asked them to pass the debt to Debt Recovery but they refused. They sent us a letter saying while we were making payments that they would not pass the debt on, however if we missed a payment, then the account would be closed and passed on to the Debt Recovery where interest would be frozen.
Can I ask CCCS not to pay LLoyds this month but pay all the other creditors?(who so far have been ok). At the rate we are going we will be paying interest forever!
Any advice would be greatly received

Hi Sou7 and thank you for your post.
Have you considered switching to a credit card with a 0% interest rate? This article gives you more information on this and how you can do it: http://www.moneysavingexpert.com/cards/balance-transfer-credit-cards
If you can’t apply for another card, for example if you have a poor credit rating, I’d recommend that you put together an income and expenditure to work out how much you can realistically afford to pay them each month. You can then send this to them as proof that you can’t afford to pay them any more.
If you bank with Natwest, you should open up a basic bank account elsewhere to prevent them from helping themselves to any money in your account.
If you’d like some more detailed help and advice, we’d need some more information from you. You could either use our online advice facility Debt Remedy, or ring our free Helpline to book a telephone appointment with a counsellor.
Debt Remedy will assist you in completing a financial statement which includes information on your household, employment, income, expenditure and debts. All this information is used as a basis to determine the options available to you to deal with your situation.
Once you’ve followed the process through and completed all the required information you will immediately be presented with an advice booklet, which will provide tailored advice for you based on your current circumstances. It will also provide advice on ways you may be able to improve your situation.
Alternatively if you would prefer to talk to a debt counsellor about your situation, you can book a telephone based appointment by calling our helpline free on 0800 138 1111. Lines are open Monday to Friday 08:00-20:00.
I hope this helps.

Hello!
I recieved a letter this moring from a debt collection agency, for a debt of £261 from a company I had a shopping account with many yeasr ago (2002-ish) I had a run of bad and racked up a lot of debt about 2002 but managed to dig myself out and settle up everything by about 2004. Im sure I paid this off, and the fact I havent heard from this company, or any collectors until now makes me a bit suspicious really. Spoke to debt company, who say that Call Credit has no record of payment, spoek to the shopping company, who say the same, so I rang the bank. They told me they are suprised they have records going back as 2002 as they are only usually kept 6 years, and maybe I should ask them to prove it wasnt paid, as Im sure it was. I cannot find any trace of payment it has been so long now, but it was a small amount compared to what I owed in total, so I am positive it would have been paid off. Question is, do I still have to pay this, or should I challenge them over the fact I think it has already been paid ? Im worried about getting a black mark on my credit file as its now squeaky clean, and I d rather it stayed that way.
Thanks

Hi Neal and thank you for your message
The debt may be stature barred under the Limitations act if over the past 6 years:-
The creditor has not already obtained a county court judgment (CCJ).
You or any one else owing the money (on a debt in joint names) has not made a payment on the debt during the last six years.
You have not written to the creditor admitting you owe the debt during the last six years.
This may mean that the creditor is out of time to enforce the debt.
I have attached a letter you could use to send to the creditor

Dear Sir / Madam
You have contacted me regarding the above account.
The last payment of this debt was made over six years ago and no further
acknowledgement or payment has been made since that time. Unless you
can provide evidence of payment or written contact from me in the
relevant period under Section 5 of the Limitation Act 1980, then you will
no longer be able to take any court action against me to recover the
alleged amount claimed.
Any court claim will be defended on this basis.
In addition section 2.14 of The Office of Fair Trading Collection Guidance
states that it is unfair to pursue such claims where, as here, the creditor
has made no contact during the relevant limitation period.
If you have evidence that your claim is not statute barred then please
supply it to me within 21 days. If you are unable to provide such evidence
please confirm that no further action will be taken against me.
Yours faithfully
(Print Name)
Hope this helps

Hi I am a newbie and have found the info on the site very helpful. However I feel that I need advice more relevant to my situation.
I am a single parent living in the home I once shared with my partner. I continue to pay the mortgage. I had managed to pay off my debts and was running smootly until last summer. I inadvertantly overspent during the summer holidays. By the time charges were added it amounted to approx £400.
The bank manager gave me a small overdraft and advised me to take out a credit card to use instead of my visa. He advised that all my spending should be on that as its safer than visa. It has approx £2400 on it.
When the second payment was due I was abroad and had internet connection problems, compounded by being unable to find a telephone that worked. By the time I managed to make the payment it got to them late. I am now charged £12 per month on top of the basic payment. I was recently told that another of my payments didnt arrive at all.
I feel that the credit card situation is uncomfortable for me and I dont want it to get any further out of control.
Furthermore I need to spend some money on building work for the house. It is in a bad state. I need approx £3000 to £5000. Then I intend to sell it as I wont afford theinterest rates once they start to increase and my ex wants to be released from it..
Please would you advise me if I should take out a 0% credit card and transfer the balance, but using a standing order to pay it so that it goes out automatically every month or would a loan be more appropriate?
I would imagine the recent events with the credit card may have damaged my credit rating.
Also I am concerned as someone has taken me to court as she was unhappy with a horse truck she bought off me. She ripped up the floor before asking for a refund. I said no as I didn't have the opportunity to have it back as she had bought it. She is sueing me for the floor that she ripped up plus the initial problem which was some hidden corrosion under the floor that no one could have known about. I am annoyed as she brought an expert with her and the truk is 21 years old. It was tatty. I dont have any money to refund her. I would imagine that I may end up with a CCJ as the courts seem to think I'm the bad guy in all of it. although she bought it 'as seen', she is using the unfit for purpose angle.
So I'd like to get the credit card and/or loan situation sorted before May when the court hearing is. I'm borrowing 'off of peter to pay Paul' so to speak at the moment.
I realise this has been a bit long winded but any advice would be most appreciated, thank you.0 -
Hi, PLEASE HELP
I have been trying to obtain cca request from cabot and moorcroft.
cabot have sent back a copy of a reply card that I filled back in the year 2000. It basically is just a reply card i sent back but did sign. It has sections filled in with my printed address and sections i filled in with phone number, annual income and my signature. The box they should have signed is blank. Can you please tell me if this is a enforcable agreement as this is a reply card. It has got a small box with credit agreement regulated by consumer credit act 1974 . There is no terms or conditions or interest etc. I have been paying this until December and then asked for a cca request.
When cabot took this over ( it was first a providian national bank card then became monument) and when I first had problems the amount owing was just over 2000 but now they have added 1500 interest so it is now 3500. so all what I have paid since 2006 has been pointless. Please help as what I should do next.
Also I have been having problems with moorcroft, this is for my abbey bank account which went into default in 2006. Again I have been paying up until december and then asked for a cca requests. I finally recieved a letter saying they did not have one but was it was my obligation to pay, so I sent the section 10 letter. They wrote back stating that (I write to advise that a copy of the consumer credit agreement is unavailable as this is a bank account) and then on friday 11th I had someone knock at the door who was a debt collecting agent. He promptly started to discuss this in front of my neighbour who was only a few feet away and heard what was going on. I said I would not discuss this and that he had embarressed me infront of my neighbour and asked him to leave as he was tresspassing on private property. he replied that he new his rights and was allowed to be here. I sent the same day the letter refering to (threat of a doorstep visit) recorded. As they have not supplied a copy of my cca request how do I stand as this is a bank account which is now santandar.
Please help as to what is the best course of action or what can they do.
Mant thanks0
