Reclaiming Charges - How We're Doing

Afternoon,
I've recently written (on the 13th July) to the companies about unfair charges. Here's the responses:
Halifax; Requested a lot of statements, will get back to me in due course.
AMEX; Looking into charges, will get back to me in due course.
Capital One; Argh! Refunded only £96 to my account, which has been passed to a DCA anyway, so I can't even access that money, which I believe is more anyway. Haven't taken my default off either, said they need to look into this. The default is completely their fault too.
GE Capital; Haven't even responed.
So, that's three weeks ago that the letters were sent. Any advice on this about what I should expect, what I should do next etc?

GE Capital have decided to refund me £165!!!!!!!!
The problem is they've refunded this to the account which has since been passed to a DCA. I'd really prefere a cheque, so I called them but they said it's been adjusted so couldn't do anything. Do you reckon there's anyway I can get my hands on the £165??
Halifax - Received statements. Will go through them when I have about 700 years spare.
Amex - Told me that their charges are fair and to p*ss off basically!
Basically as I'd lost all my GE Capital, Amex & Capital One statements when I moved I don't know the exact figures I've been charged. The thing that gets me is the refunds on 2 accounts that I have no access to. GE Capital refunding £165 seems right, but I've £££'s of charges from Capital One. Amex I will write to again requesting details on all charges... Argh

they have 40 days to reply so hold tight!
When you get the statements or lists you need to work out your charges and interest and send them a letter reclaiming the charges! theirs a website which you can download the letter templates from!

Hi
Can someone please give me some advice on this.
Until about 2yrs ago I had 2 current accounts, loan and credit card with Barclays bank. I then went into default and started using a debt management company to pay Barclays back the loan, credit card and over draft. I am still currently paying that.
I would like to request a copy of all my charges for the last 6 yrs.
a) do I have to write individually or will it be enough to direct it to Barclays and state my details and individual accounts?
b) will it affect my arrangement for paying the debts off ie: can they ask me to pay everything back immediately as this is currently reviewed every 6 months. I am just a bit worried about being asked to pay the debt back but I would think that as I had defaulted and am with a debt managment company it would be of no use.

Hold firm. You asked for information, not a refund. I suggest that you contact them and reiterate your Subject Access Request...
Also, have they actually told you that it was a refund of charges? Do note that the OFT recommended a maximum £12 charge. Some might just refund the difference.[strike]-£20,000[/strike] 0!0 -
Ive sent letters off to Barclays, Barclaycard & Capital One.
Barclaycard have told me it will cost £10 for the DPA check and £3 for each copy statement. So going back the 5 years Ive had a Barclaycard to check the default charges would cost me £180 !! Any way around this?0 -

That's awful!
I went into my Halifax branch and they said that it will cost £5 per statement (I wanted all accounts since 2002 onwards, so 4years x 12months x 5 accounts!!!). I just used the standard letter on the consumeractiongroup website, stuck a £10 cheque in there and they sent them a few weeks after, all recorded delivery in a big bag!£2 Coin Savings = £0.23

If you're using the letter from The Consumer Action Group ( link in another post above) then you are making a Subject Access Request under the Data Protection Act and £10 is all you have to pay by law. You are requesting specific information via the Subject Access Request and they are obliged by law to provide you with this.
They will try to fob you off but you are not requesting copy statements as such, you are requesting a list of the charges , and the letter explains that copy statements will be acceptable to you if they prefer to provide the information in this way.
Remind them of their obligations under the Data Protection Act - that usually gets them towing the line!0
