I only enclosed £10 with each reuest and got 6 years worth of statements - Sainsburys didn't cash the check and Halifax credited it to my (closed) credit card account. So in other words Barclaycard are trying to frighten you off....they have a legal obligation to provide you with the information you want and can charge no more than £10 for the service.

  • If you had a look at the step by step guide you will see the template of letters to use.

    I would write to the ones you are waiting on statments for advising them the 40 days are ticking. If they dont respond there is a template in consumer action forum for non compliance of DPA request. I had to do this with the Halifax and I also complained to the Information Commissioner. In the end I got my statements.

    With regards to capital one, I would need more info as to what letter you sent them that they refunded some of the charges. If you sent the DPA reuest, you then send the prelim letter (again in bank templates on consumer action group) then the letter befor action if they havent responded within 14 days. 14 days after the Letter before action is sent if no response you can then file a claim in court and charge back 8% interest on each charge and also the cost of the court fee.

    nice one... ive just gotta be careful as i have no printer at home and have to do all my letters at work - is a proper nightmare. But if you do have any other hints & tips that would be great :)

  • Ooops forgot to mention about your default. There are numerous posts on CAG (consumer action group) about getting the default removed. Again without knowing the full situation I really cant comment. however, there is a letter here:

    I have just started doing this so not too sure how it is gonna work out. If you have your credit file I would also check that the DCA hasnt also defaulted you for the same debt.

    i have just started to clear up my credit file and found I had 2 defaults for the same debt, one from original lender and one from DCA, which I have found out they cant do, so again Im in the middle of sorting this out.

    Regarding the charges and non compliance of DPA. Im no expert but have been claiming a few for myself so any help you need I can try help from my experience.

    Would certainly recommend if you have time to have a read about the consumer forum on the default and charges. Loads of useful info there.

    Just worked out your 40 days should be up on wed 23rd August? I didnt receive my statements from the Halifax til 3 weeks after the 40 days were up and I harassed them with phone calls and got nowhere. Eventually I spoke to Mark Kellett tel no: 01422 332991. He was extremely helpful, i advised I would be taking it further and had complained to the Information Commissioner. I then received 2 lots of statements 3 days later. Might be worth a try, he was a really nice guy.
