Got the subject to access which has no statements of the accounts whatsoever, the other company who the debt was has sent a cca which is not signed by either party and it a totally lesser amount than the court order and restriction on the house..

Total by cca is 1400 and the restriction for the same company is over 6.000..

The other things that I have found are no signed or original cca and the date of birth they have are not right by date and year

I need to sort this asap but not sure what action I should take next can someone help please?

What documentation is there regarding the court case?

Did the court papers re the CCJ and CO go to the address where you were living? or to anotehr address?

Sorry there is a lot to unpick and I have to go early.

I think once the whole bundle is unpacked that 10past6 will be your man, as COs are his speciality.

He really needs some sort of time line.

Do you think this debt is even your OH's or is it completely mistaken?

We know nothing of any debt to citi finance that's who is was and cabbot took over so they said..

We had threatening letters last year telling us our house would be taken if we didnt pay after many letters of asking for cca's they said they didn't have to give us that as they already had court order and restriction on house.

I was then told by someone on here it didn't matter about cca to send for SAR WHICH I did and we have just got it.. Now this all went on in october 2008 so we have been waiting for sometime for all the details to get this removed as such.

They citi) sent cca but nothing on it no details only amount of £1.400 no signiture or details of who it's for but the court order from cabot is for over 6.000 with restriction on the house which again we know nothing about..

Now we have two roads very similar name to where we live and have had post which is 2 year's old delivered to us from there so maybe this is where the lette's have gone I don't really know..

I must also add there is no records of any payments in the sar at all and it was 2003

All I know is the amounts are not right nor is the cca and we need to get this sortted

You need to get this into a more structured form if people are to help you.

So someone took out a debt (loan/card/account) with Citi Finance - what is the date on the CCA?

In the paperwork from the Subject Access request, they have to supply the signed CCA. What account was that for?

Loan taken out with citi finance 2003 for 5.000

last payment made for 50.00 on the 31/08/04

Sold debt to cabot 2007

Default notice from citi never processed from them

default notice from carbot 30th Nov 2004 never received at our address


Court judgment made In northampton county court sept 2008, No paper work at all received and called the court and they did confirm no contact from us whatseoever..

Restriction on house oct 2008 also not received by us and confirmed by court no reply from our address



We have standard letters in the sar but no details at all on them

There is no date on the cca just a letter stating how much is owed which is £1.225 which is totally different amount to the courtorder/restriction..

The date of that last letter from citi is the balance owing date 17/02/10
